secondo <strong>la</strong> legge, «the State shall adopt measures to protect consumers in the legal<br />
exercise of their rights and shall safeguard consumers legal rights and interests».<br />
Tuttavia, <strong>la</strong> Consumer Protection Law non contiene nessuna previsione per quanto<br />
riguarda le modalità attraverso le quali il Governo deve realizzare detta protezione.<br />
Secondo l’art. 26, infatti, il Governo è so<strong>la</strong>mente obbligato a «listen to and take into<br />
account the views and requirements of consumers».<br />
Pertanto, al riconoscimento <strong>del</strong> diritto <strong>dei</strong> consumatori al<strong>la</strong> <strong>sicurezza</strong> e qualità <strong>dei</strong><br />
<strong>prodotti</strong>, in Cina non corrisponde <strong>la</strong> creazione di un apposito organo statale che ne<br />
garantisca <strong>la</strong> re<strong>la</strong>tiva tute<strong>la</strong>. Il Governo, infatti, si limita a prescrivere e comminare<br />
sanzioni penali contro i venditori o i produttori, nei casi in cui i loro comportamenti<br />
integrino ipotesi di reato previste dal diritto penale 292 .<br />
Appare evidente che <strong>la</strong> mancata previsione di un meccanismo di applicazione<br />
direttamente affidata ad un organo statale ostaco<strong>la</strong> gravemente l’efficacia <strong>del</strong><strong>la</strong><br />
normativa.<br />
Rispetto a questa mancanza, viene in rilievo il secondo approccio applicativo: in<br />
base a quanto disposto dall’art. 34, i consumatori possono risolvere le controversie con<br />
gli operatori economici sui loro diritti e interessi nei seguenti modi: (1) negotiate a<br />
settlement with the business operator; (2) request a consumer association to mediate;<br />
(3) comp<strong>la</strong>in to the relevant administrative department; (4) apply to an arbitral body<br />
for arbitration in accordance with the arbitration agreement reached with the business<br />
operator; (5) institute legal proceeding in a People s Court.<br />
Inoltre, l’art. 6 <strong>del</strong><strong>la</strong> Consumer Protection Law prevede espressamente che «the<br />
whole society shall bear responsibility for the protection of consumers legal rights and<br />
interests». Si tratta di una norma programmatica piuttosto generica, senza alcun preciso<br />
contenuto precettivo; tuttavia, proprio sul<strong>la</strong> base di questa disposizione, è stato<br />
attribuito un ruolo molto importante all’Associazione Cinese <strong>dei</strong> Consumatori, <strong>la</strong> quale<br />
