The Treaty of Lisbon and the common security and defence policy<br />
informed on the development of the foreign and security policy (article 21<br />
TEU - Nice).<br />
Under the Treaty of Lisbon the Commission no longer enjoys right<br />
of initiative in CFSP matters, as it is the HR in this capacity who may<br />
submit proposals to the Council in this field (article 18. 2 TEU - Lisbon).<br />
Nevertheless, pursuant to article 17.1 TEU - Lisbon, except in CFSP matters<br />
and in other cases provided for by the treaties, the Commission shall<br />
ensure the Union’s external representation.<br />
Other Institutions<br />
The Court of Justice of the European Union and the Court of Auditors<br />
do not have jurisdiction in CFSP matters.<br />
Article 24 of the TEU - Lisbon establishes that the Court of Justice<br />
of the European Union shall not have jurisdiction with respect to the<br />
provisions on CFSP, with the exception of its jurisdiction to monitor<br />
compliance with article 40 of the Treaty, concerning enhanced cooperation,<br />
and to review the legality of certain decisions as provided for by<br />
article 275 of the Treaty on the Functioning of the European Union, in<br />
relation to the establishment of restrictive measures against natural or<br />
legal persons.<br />
OTHER CFSP BODIES<br />
High Representative of the Union for Foreign Affairs and Common<br />
Security Policy<br />
One of the chief novelties introduced by the Treaty of Lisbon in the field<br />
of CFSP is the new figure of the High Representative for Foreign Affairs<br />
and Security Policy / Vice-President of the Commission. As the HR is also<br />
one of the Vice-Presidents of the Commission, in which capacity he is in<br />
charge of the Union’s external relations and action, his appointment as<br />
such is subject to the rules applied to the Commission and, therefore, to<br />
the approval of the EP.<br />
The HR heads the CFSP, chairs the Foreign Affairs Council and ensures<br />
the consistency of the Union’s external action (article 18 TEU - Lisbon).<br />
When the Union has defined a position on a subject which is on the United<br />
Nations Security.<br />
