H–19. Exercise and evaluation<br />

Exercise planning <strong>of</strong>ficials at the (insert installation title) and (insert civil parties) will coordinate exercises that will<br />

allow interaction between all parties. They will notify each other <strong>of</strong> upcoming exercises and invite each other to<br />

participate, observe, and/or critique exercises <strong>of</strong> mutual interest. Regular participation in these exercises will assist with<br />

the continued improvement <strong>of</strong> response efforts.<br />

H–21. Contract services<br />

(Insert civil parties) and (insert installation title) will make any emergency service contracts it has with private<br />

contractors available to each other when available. (Insert installation title)’s use <strong>of</strong> such contracts may be limited by<br />

Federal and State procurement laws and policies, budgetary constraints, and the ability <strong>of</strong> the (insert civil parties)<br />

contractors to perform acceptably for both the (insert civil parties) and (insert installation title) during an emergency.<br />

H–22. Accounting and reimbursement<br />

a. (Insert installation title) will not deny requests <strong>of</strong> an immediate nature solely due to the inability or unwillingness<br />

<strong>of</strong> the requestor to reimburse the <strong>Army</strong>. (Insert installation title) will ordinarily provide support on a cost-reimbursable<br />

basis and will comply with legal and accounting requirements for the loan, grant, or consumption <strong>of</strong> DOD resources<br />

under applicable authority.<br />

b. Except for fire and emergency services, (insert installation title) must separately contract for services that it<br />

requests from the local civil authority. (Insert installation title) must adhere to existing <strong>Army</strong> reimbursement policies<br />

and guidance.<br />

c. (Insert accounting and reimbursement arrangements agreed to by all parties under this agreement. Include all<br />

terms and conditionals <strong>of</strong> financial relationships, procedures for record keeping, procedures for submitting and<br />

adjudicating disputes, and the use <strong>of</strong> fees. The agreement should also specify when expenditures will be authorized,<br />

what expenditures will be reimbursed, who can authorize expenditures, and how accounting for expenditures and<br />

reimbursement will take place).<br />

H–23. Indemnity and liability<br />

(Insert installation title) and (insert civil parties) waive all claims against each other for compensation for any loss,<br />

damage, personal injury, or death occurring as a consequence <strong>of</strong> the performance <strong>of</strong> this agreement. This provision<br />

does not waive any right to reimbursement the parties may otherwise have.<br />

Note. Although the <strong>Army</strong> can agree to waive all claims that it has against the civil party, it cannot agree to waive claims that DOD<br />

personnel may have in their individual capacities nor agree to indemnify the local civil authorities in such cases.<br />

H–24. Resolution <strong>of</strong> conflicts<br />

H–25. Date effective<br />

This agreement will be effective on (insert the date or conditions that render this agreement effective, such as the date<br />

that the last party signs the agreement).<br />

H–26. Review and revision<br />

This agreement will be reviewed and revised annually at a minimum. Changes in the national security and threat<br />

environment, updates to local planning documents, and other changes may necessitate out-<strong>of</strong>-cycle revisions.<br />
