Development of national migration policies based on comprehensive<br />

legislation governing the admission, residence, expulsion and naturalization<br />

of foreigners.<br />

Establishment of policies, domestic legislation and institutions that are<br />

transparent and flexible, provide consistency, offer better information<br />

and allow for review and development.<br />

Creation or strengthening of administrative structures for migration<br />

management and provision of sufficient capacity to manage migration.<br />

Facilitation of coordination among responsible authorities at all stages<br />

in the migration process including through inter-ministerial consultations<br />

and, where appropriate, consideration to centralizing migration<br />

in a dedicated ministry or agency oriented toward increasing fairness,<br />

speed and efficiency of administrative decisions and procedures.<br />

Development of national migration policies that take account of and<br />

are consistent with regional and sub-regional processes on migration.<br />

Development of national migration policies in active consultation and<br />

cooperation with important stakeholders in the field of migration<br />

including the private sector, non-governmental organizations and<br />

other members of civil society, in order to enhance the public acceptance<br />

and effectiveness of policies and promote social cohesion.<br />

3. Entry and Stay<br />

States have the responsibility to determine the conditions for the entry and<br />

stay of non-nationals in their territories, for the protection of their citizenry<br />

and national interests, subject to applicable international law requirements.<br />

Policies in this domain are designed to achieve a balance between facilitation<br />

and the control of the number and composition of persons crossing international<br />

borders and the conditions under which entry is authorized or<br />

denied. Types of authorized entry can include permanent entry, such as for<br />

labour, family reunion or on humanitarian grounds, as well as temporary<br />

entry to visit, study, and work for defined periods of time. Refusal of entry can<br />

be based on such grounds as criminality, terrorism, public health and the<br />

desire to protect the domestic labour market. Certain benefits and opportunities<br />

may be made available only to nationals and authorized non-nationals.<br />
