Opinion by Bro<strong>the</strong>r Henry Phillips, <strong>of</strong> No. 16.<br />

This case comes on appeal from three members <strong>of</strong> America <strong>Lodge</strong>,<br />

located at Sherman, seven miles north <strong>of</strong> Springfield. The charges and<br />

trial are <strong>the</strong> outgrowth <strong>of</strong> difficulties resulting from <strong>the</strong> organization <strong>of</strong><br />

a new <strong>Lodge</strong> at Sberman.<br />

In 1908 <strong>the</strong> building occupied by America' <strong>Lodge</strong> was destroyed<br />

by fire. Bro<strong>the</strong>r Flagg, <strong>the</strong> accused, was at that time Noble <strong>Grand</strong><br />

<strong>of</strong> <strong>the</strong> <strong>Lodge</strong>. In company with <strong>the</strong> Trustees Bro<strong>the</strong>r Flagg went to<br />

Springfield and assisted in renting a <strong>Lodge</strong> room in a building owned<br />

by <strong>the</strong> Reisch Brewing Co. No written lease was made. The agent<br />

<strong>of</strong> <strong>the</strong> owner, Mr. Gus Maurer, rented <strong>the</strong> room to America <strong>Lodge</strong><br />

month by month, at a rental <strong>of</strong> $5.00. It was agreed that <strong>the</strong> rent<br />

should be paid for <strong>the</strong> <strong>Lodge</strong> by Bro<strong>the</strong>r Flagg. This was done for<br />

about three years. All receipts for rent are shown in <strong>the</strong> record and<br />

were to America <strong>Lodge</strong> No. 920. After his retirement as Noble <strong>Grand</strong><br />

in April, 1910, Bro<strong>the</strong>r Flagg was elected a Trustee <strong>of</strong> said <strong>Lodge</strong> and<br />

his name recorded as such in <strong>the</strong> recorder's <strong>of</strong>fice <strong>of</strong> Sangamon county.<br />

Thereupon he entered upon <strong>the</strong> performance <strong>of</strong> <strong>the</strong> duties <strong>of</strong> that<br />

<strong>of</strong>fice. This position he continued to hold until May 22, 1911, when his<br />

successor was duly elected and qualified.<br />

The record shows that <strong>the</strong> <strong>Lodge</strong> room was rented to o<strong>the</strong>r bodies<br />

when not occupied by America <strong>Lodge</strong> and that Bro<strong>the</strong>r Flagg received<br />

such rentals and paid <strong>the</strong> Reisch Brewing Co. for <strong>the</strong> <strong>Lodge</strong>. Some<br />

time about May 1, 1911, Bro<strong>the</strong>r Flagg went to <strong>the</strong> owner <strong>of</strong> <strong>the</strong> build-<br />

ing and had <strong>the</strong> verbal lease to <strong>the</strong> <strong>Lodge</strong> room cancelled and rented<br />

it in his own name. He paid <strong>the</strong> rent in advance for <strong>the</strong> months <strong>of</strong>
