<strong>Lodge</strong> in refusing to pay benefits for <strong>the</strong> period from September 5,<br />

1904, to October 21, 1907.<br />

"The family <strong>of</strong> our deceased Bro<strong>the</strong>r are <strong>of</strong> <strong>the</strong> opinion that <strong>the</strong><br />

<strong>Lodge</strong> is indebted to <strong>the</strong>m for benefits covering <strong>the</strong> period mentioned.<br />

In order that no injustice may be done, I--recommend that <strong>the</strong> case be<br />

referred to <strong>the</strong> incoming <strong>Grand</strong> Master for fur<strong>the</strong>r examination and<br />

action. .<br />

The Honorable W. M. Groves, who succeeded Bro<strong>the</strong>r Scott as<br />

<strong>Grand</strong> Master, appointed Bro<strong>the</strong>r A. T. Roner as his special Deputy<br />

to conduct a thorough investigation and report all <strong>the</strong> facts in con-<br />

nection with <strong>the</strong> case. Bro<strong>the</strong>r Roner went into <strong>the</strong> matter very extensively<br />

and heard testimony on behalf <strong>of</strong> <strong>the</strong> family and also on<br />

behalf <strong>of</strong> <strong>the</strong> <strong>Lodge</strong>. He reported to <strong>the</strong> <strong>Grand</strong> Master that in his<br />

opinion <strong>the</strong> claim should not be sustained and <strong>Grand</strong> Master Groves<br />

approved <strong>the</strong> decision made by his special Deputy, Bro<strong>the</strong>r Roner, and<br />

<strong>the</strong> <strong>Grand</strong> <strong>Lodge</strong> approved <strong>the</strong> <strong>Grand</strong> Master's action.<br />

"THE ROOS CASE."<br />

"On page 370 <strong>of</strong> <strong>the</strong> Journal <strong>of</strong> 190S. in <strong>the</strong> <strong>Grand</strong> Master's Supplemental<br />

Report, he refers <strong>the</strong> claim <strong>of</strong> Mr. Otto Roos, son <strong>of</strong> Edward<br />

Roos, deceased, late member <strong>of</strong> Lily <strong>of</strong> <strong>the</strong> West <strong>Lodge</strong> No. 407, to me<br />

for fur<strong>the</strong>r investigation, and I appointed as my special deputy, Bro.<br />

A. T. Roner, who gave <strong>the</strong> claim a thorough investigation, and re-<br />

ported to me that, in his opinion, <strong>the</strong> <strong>Lodge</strong> should be sustained in<br />

refusing to pay <strong>the</strong> claim, and I concurred in his opinion."<br />

The <strong>Grand</strong> Master's action was approved by <strong>the</strong> <strong>Grand</strong> <strong>Lodge</strong>.<br />

On <strong>the</strong> 19th day <strong>of</strong> November, 1909, suit was instituted in <strong>the</strong><br />

Municipal Court <strong>of</strong> Chicago by Rosa Roos, Otto Roos and Ida Roos,<br />

Trustees under <strong>the</strong> last will and testament <strong>of</strong> Edward Roos, against<br />

Lily <strong>of</strong> <strong>the</strong> West <strong>Lodge</strong>, to recover <strong>the</strong> sum <strong>of</strong> One Thousand Dollars<br />

($1,000) for sick benefits.<br />

The <strong>Lodge</strong> defended this suit and on June 30, 1910, <strong>the</strong> court found<br />

<strong>the</strong> issues for <strong>the</strong> plaintiffs and assessed <strong>the</strong> plaintiff's damages in <strong>the</strong><br />

sum <strong>of</strong> Six Hundred ,Sixty-nine Dollars ($669).<br />

1910, <strong>the</strong> <strong>Lodge</strong> filed its writ <strong>of</strong> error in <strong>the</strong> Appellate<br />

On <strong>the</strong> 11th day <strong>of</strong> December, 1912, <strong>the</strong> judgment <strong>of</strong> <strong>the</strong> Municipal<br />

Court was affirmed by <strong>the</strong> Appellate Court.<br />

The Appellate Court based its decision upon Section 211 4 <strong>of</strong><br />

Merrills' Code, 1906, which provides as follows: "A <strong>Lodge</strong> Bv-Law
