admission to a lodge at his place <strong>of</strong> residence in West Virginia by<br />

withdrawal card in date.<br />

Question.— Should he be admitted under <strong>the</strong> Transfer Law, or<br />

should he be required to pay an admission fee?<br />

Answer.—He should not be admitted under <strong>the</strong> Transfer Law, but<br />

required to pay such fee as is provided by your local law. Busbee's<br />

Digest, Sec. 448.<br />

Dec. 25. Statement.—A bro<strong>the</strong>r is taken seriously ill and is removed<br />

to <strong>the</strong> hospital lor an operation. He had a private room, and<br />

<strong>the</strong> doctor ordered that a private nurse be procured, as it was a critical<br />

case. The bro<strong>the</strong>r paid three dollars per day for his room, and in<br />

addition to that had. to pay twenty-one dollars per week for <strong>the</strong> nurse,<br />

also her board and laundry, for five consecutive weeks.<br />

Question.—Shouldn't <strong>the</strong> <strong>Lodge</strong> pay what <strong>the</strong> by-laws provide for<br />

watchers (which in this case is ten dollars and a half per week) towards<br />

nurse hire?<br />

Answer.—Yes.<br />

Dec. 26. Statement.—On January 15 Eureka <strong>Lodge</strong>, No. 13, Deadwood,<br />

South Dakota, in regular session voted to donate one hundred<br />

dollars ($100.00) to <strong>the</strong> Deadwood Auditorium fund from <strong>the</strong> contingent<br />

fund in <strong>the</strong> hands <strong>of</strong> <strong>the</strong> trustees. The trustees refused to pay<br />

over <strong>the</strong> money on <strong>the</strong> ground that as an Odd Fellows' <strong>Lodge</strong> we have<br />

no right to make any such donations, and an appeal was made by <strong>the</strong><br />

<strong>Lodge</strong> to <strong>the</strong> <strong>Grand</strong> Master, who ruled that said donation could be<br />

made, as it would be a benefit to <strong>the</strong> property owned by <strong>the</strong> <strong>Lodge</strong>.<br />

The trustees <strong>the</strong>n gave notice that <strong>the</strong>y would pay <strong>the</strong> money only<br />

under protest ordered by a vote <strong>of</strong> <strong>the</strong> <strong>Lodge</strong>. The <strong>Lodge</strong> by vote<br />

ordered <strong>the</strong> trustees to pay said donation <strong>of</strong> one hundred dollars under<br />

<strong>the</strong>ir protest.<br />

Question.—Where is <strong>the</strong> law permitting such donations by an<br />

Odd Fellows' <strong>Lodge</strong>?<br />

Answer.—There is no such law. The contingent fund can not be<br />

used for donations or subscriptions for public uses. Journal 1912, page<br />

Dec. 27. Question withdrawn and decision omitted from <strong>the</strong><br />

printed journal <strong>of</strong> proceedings. See Report 115, page 140, Daily Pro-<br />

ceedings <strong>of</strong> 1913.<br />

Dec. 28. Question.—Does <strong>the</strong> anti-smoking law prohibit smoking<br />

in <strong>the</strong> ante-room or side rooms when <strong>the</strong> <strong>Lodge</strong> is in session?<br />

Answer.—Our law prohibiting smoking in <strong>the</strong> <strong>Lodge</strong> room when in<br />

session does not deprive bro<strong>the</strong>rs <strong>of</strong> <strong>the</strong> privilege <strong>of</strong> smoking in any<br />

side room riot an ante room, or in <strong>the</strong> <strong>Lodge</strong> room when <strong>the</strong> <strong>Lodge</strong> is<br />

not in session.
