as per enclosed blank certificate. Committee reported favorably May<br />

20, 1912; initiated June 3, 1912; received <strong>the</strong> third degree June 18, 1912.<br />

Became an inmate <strong>of</strong> <strong>the</strong> Territorial Insane Asylum November 6, 1912,<br />

suffering with paranoia with mania and is still an inmate <strong>of</strong> <strong>the</strong> insane<br />

asylum.<br />

Question 1.—Did Bro. August Bomke and <strong>the</strong> two recommending<br />

bro<strong>the</strong>rs, by concealing from <strong>the</strong> <strong>Lodge</strong> his previous detention in an<br />

insane asylum, render his application, initiation and membership<br />

illegal?<br />

Answer.—No. His initiation was legal unless he was insane at<br />

that time. Journal 1905, pages 75, 299, 323.<br />

Question 2.— Shall Bro. August Bomke be expelled from <strong>the</strong> Order<br />

or shall his initiation be declared void?<br />

Answer.—You can not expel him unless he was guilty <strong>of</strong> some<br />

fraud in gaining admission, and you can not declare his initiation void<br />

unless he was insane when admitted. Busbee's Digest, 995, 996, 997.<br />

Question 3.—If his entrance was illegal is he entitled to any reimbursement<br />

for fees and dues collected to date?<br />

Answer.—No.<br />

Question 4.—Were Bro. August Bomke and <strong>the</strong> bro<strong>the</strong>rs who<br />

recommended him justified in concealing from <strong>the</strong> <strong>Lodge</strong> <strong>the</strong> fact <strong>of</strong><br />

his previous detention in an insane asylum, in view <strong>of</strong> <strong>the</strong> fact that<br />

he was passed by <strong>the</strong> examining physician and it had been four years<br />

since he was discharged from <strong>the</strong> insane asylum?<br />

Answer.— Unless <strong>the</strong>y had at that time reason to believe <strong>the</strong> applicant<br />

was still insane <strong>the</strong> failure to tell <strong>of</strong> <strong>the</strong> fact <strong>of</strong> his previous in-<br />

sanity could hardly be called a willful wrong, especially in view <strong>of</strong> <strong>the</strong><br />

fact that <strong>the</strong> form <strong>of</strong> <strong>the</strong> examining physician's certificate submitted<br />

shows that <strong>the</strong> doctor certified that he had made an examination <strong>of</strong><br />

August Bomke and found no diseased condition <strong>of</strong> <strong>the</strong> skin, eyes, ears,<br />

nose, throat, lungs, heart, abdominal viscera, including an examination<br />

<strong>of</strong> his urine, and general nervous system, and recommended him as<br />

a good risk to an organization paying risk and death benefits.<br />

Question 5.—In <strong>the</strong> event <strong>of</strong> a decision stating him a member in<br />

good standing, is he entitled to benefits—<strong>the</strong> illness having originated<br />

previous to his entering our Order?<br />

Answer.—Yes, unless he was insane when initiated, and this must<br />

first be determined under a proceeding for that purpose, <strong>of</strong> which he<br />

must have full notice. Journal 1905, pages 75, 300, 323.<br />

Dec. 24. Statement.—A bro<strong>the</strong>r who holds membership in <strong>the</strong><br />

Jurisdiction <strong>of</strong> Ohio, and changes his residence to <strong>the</strong> Jurisdiction <strong>of</strong><br />

West Virginia, takes his withdrawal card and afterwards applies for
