VORBEMERKUNGEN 3 INTRODUZIONE desentwicklung und Raumordnung handelt es sich, wie die Bezeichnung klar aussagt, um allgemeine Bestimmungen. Einzelbestimmungen der geltenden Gesetzgebung können in Widerspruch zu ihnen stehen bzw. abweichen. Im konkreten Einzelfall wird es also auf die sorgfältige Abwägung der widersprüchlichen Rechtsgüter ankommen. Der geltende Rechtsgrundsatz "lex posterior derogat priori" besitzt in diesem Zusammenhang keine so absolute und starre Bedeutung, daß bereits bestehende Einzelnormen im Widerspruchsfall automatisch durch die neu eingeführten allgemeinen Bestimmungen ("allgemeine Grundsätze") aufgehoben werden. Es wird also in solchen Fällen der Abwägung und in gravierenden Fällen sogar der Anpassung an die "allgemeinen Grundsätze" durch Novellierung bzw. ausdrückliche Aufhebung einzelner bestehender Gesetze oder Bestimmungen bedürfen. Die künftige Gesetzgebung sollte sich jedenfalls von diesen programmatischen Bestimmungen als oberste Richtlinie für die Landesentwicklung und Raumordnung leiten lassen. Ergänzt wird der LEROP weiter durch einen Projektkatalog, in welchem einige wesentliche Vorhaben von Landesinteresse und bereichsübergreifender Natur angeführt werden. Die Zielvorstellungen von LANDESENTWICK- LUNGS- und RAUMORDNUNGSPLAN zum SÜD- TIROL-LEITBILD 2000 sind von den Landesbehörden bei der Erfüllung ihrer Aufgaben zu beachten und bei deren Programmen und Maßnahmen zu berücksichtigen. Die Gemeinden und anderen Lokalkörperschaften sind gehalten, gemeinsam mit der Landesregierung und -verwaltung an der Verwirklichung mitzuwirken und darüber hinaus eigene Maßnahmen zu ergreifen. In concreto si dovrà quindi operare un'attenta valutazione dei vari aspetti giuridici. Il principio giuridico per cui "l'ex posterior derogat priori" non possiede in tale contesto valore assoluto, ragion per cui in caso di antinomia le singole norme non vengono automaticamente sostituite dalle disposizioni generali di nuova introduzione ("Principi fondamentali"). In tale eventualità si renderà quindi sempre necessaria un'attenta ponderazione e, in casi particolari, addirittura un adeguamento ai "Principi fondamentali" mediante la revisione ovvero l'abolizione di singole leggi o norme. In futuro, la legislazione dovrebbe comunque attenersi come direttiva assoluta per lo sviluppo provinciale e il coordinamento territoriale alle disposizioni programmatiche. Al LEROP si allega inoltre un elenco progetti che definisce una serie di interventi di interesse provinciale riguardanti più settori. Nell'adempimento dei propri impegni, nei relativi provvedimenti e nello svolgimento dei loro programmi le autorità Provinciali dovranno rispettare gli obiettivi stabiliti dal Piano Provinciale di Sviluppo e di Coordinamento Territoriale. I comuni e gli altri enti locali sono tenuti a collaborare con la Provincia nella realizzazione del progetto, contribuendovi anche con iniziative proprie. Riferimenti internazionali e mega-tendenze Internationale Verflechtung 1 Quadro internazionale 1 Die fortschreitende Verwirklichung des Binnenmarktes, aber auch viele andere Faktoren in der internationalen Entwicklung tragen dazu bei, daß auch Länder und Regionen grenzüberschreitend tätig werden; die internationalen Beziehungen können nicht mehr allein den Zentralregionen überlassen bleiben. Dem Land Südtirol stehen zwar formell aufgrund seines verfassungsrechtlichen Gefüges keine internationalen Beziehungen zu. Alle internationalen Verträge und Beziehungen hat sich bisher die italienische Regierung strikt vorbehalten; in dieser Haltung wurde sie von mehreren Urteilen des Verfassungsgerichtshofes bestärkt. Trotzdem pflegt unser Land, besonders seit dem Inkrafttreten des neuen Autonomiestatutes, enge und rege Kontakte zu anderen Ländern und Regionen und betreibt mit diesen eine sehr fruchtbare grenzüberschreitende Zusammenarbeit. Zu erwähnen ist in diesem Zusammenhang außer dem auf dem Pariser Vertrag zwischen Österreich und Italien beruhenden Sonderabkommen Südtirol- Trentino und Tirol-Vorarlberg für den bevorzugten Warenaustausch (Accordino) vor allem die Tätigkeit der Arbeitsgemeinschaft Alpenländer (ARGE- ALP), welche im europäischen Geiste und im Lichte wirklich empfundener Anliegen der Bevölkerung im Jahre 1972 gegründet wurde. In ihr erörtern 10 Alpenregionen gemeinsam berührende Probleme, pflegen einen Erfahrungsaustausch in den verschiedenen Bereichen und treffen auch bürgernahe Lösungen; kurz gesagt, sie versuchen, trotz verschiedener unterschiedlicher Interessen, ein Stück freien Europas zu bauen. Südtirol konnte als mehrsprachiges Land beim Aufbau seiner neuen erweiterten Landesverwaltung einen nicht ü- berschätzbaren Nutzen aus dieser Zusammenarbeit ziehen. Gerade die ARGE-ALP hat aufgezeigt, daß die staatlichen Gebilde nicht mehr geeignet sind , die großen Probleme unserer Zeit zu lösen. Denkt man an die Luftreinhaltung, den Gewässerschutz, die Umweltproblematik insgesamt, so La realizzazione del Mercato unico europeo ed altri importanti fattori di politica internazionale hanno contribuito a creare una situazione in cui anche le regioni e le province operano oltre i propri confini. I rapporti internazionali non possono quindi più rimanere prerogativa esclusiva dei poteri centrali. Il diritto costituzionale stabilisce che la Provincia Autonoma di Bolzano non possieda formalmente alcuna competenza in materia di relazioni internazionali. Il Governo italiano si è quindi riservato finora la prerogativa di stipulare trattati e di intrattenere relazioni internazionali, in ciò confermato da numerosi giudizi emessi dalla Corte costituzionale. Ciò nonostante, e soprattutto dopo l'entrata in vigore del Nuovo Statuto di Autonomia, la Provincia Autonoma di Bolzano intrattiene stretti rapporti con altre regioni ed altri paesi, con cui collabora con successo. Oltre all'accordo speciale per lo scambio privilegiato di beni fra il Trentino-Alto Adige e il Tirolo- Vorarlberg (Accordino), fondato sull'accordo internazionale di Parigi fra Austria e Italia, va ricordata in questo contesto soprattutto l'attività della Comunità di lavoro delle regioni alpine, l'ARGE-ALP, costituita nel 1972 con spirito europeo e sulla scorta delle reali esigenze della popolazione. Per 10 regioni alpine, l'ARGE-ALP rappresenta un'occasione per discutere e individuare soluzioni comuni a problemi comuni, per scambiare le proprie esperienze nei campi più diversi: un tentativo di realizzare, nonostante i diversi interessi, un'Europa libera. Grazie alla sua realtà multilingue, l'Alto Adige ha potuto beneficiare in modo considerevole di questa cooperazione nell'impostare la sua nuova ed ampliata Amministrazione provinciale. Proprio l'ARGE ALP ha dimostrato che i singoli stati non sono più in grado di affrontare e risolvere isolatamente i problemi di più ampia portata. Basti pensa- re alle misure contro l'inquinamento atmosferico, alla tutela delle acque, alla problematica ambientale in generale, ed appare subito chiaro 1 Vgl.
