288, Discipline of s p 01 aircraft. It is lawful for the master or other<br />

person in command<br />

(a) A vessel on a voyage; or<br />

(b) An aircraft on a flight,<br />

himself and for any person acting by his authority to use, for the purpose<br />

of maintaining good order and discipline on board the vessel or aircraft,<br />

such force as he or such person acting by his authority believes, on<br />

reasonable grounds, to be necessary, and as is reasonable under the<br />

circums tances.<br />

performing in good faith and with reasonable care and skill a surgical<br />

operation upon any person for his benefit, or upon an unborn child for<br />

all circumstances of the case.<br />

3. Excessive Force. In any case in which the use of force by one<br />

person to another is lawful the use of more force than is justified by law<br />

under the circu~stances is unlawful.<br />

of his own death does not affect the criminal responsibility of any person<br />

who has such charge, to provide for that other person the necessaries<br />

of life: and he is held to have caused any consequences which result to<br />

the life or health of the other person by reason of any omission to perform<br />
