stealing, and which is an offence under the laws in force in the place<br />

where it was done, brings such property into <strong>Queensland</strong>, or has it in his<br />

possession in <strong>Queensland</strong>, is guilty of a crime, and is liable to the same<br />

punishment as if he had stolen it in <strong>Queensland</strong>; but so that the punish-<br />

ment does not exceed that which would be incurred for the same act<br />

under the laws in force in the place where the act by which he obtained<br />

the property was done.<br />

s. Any person who?<br />

being the mortgagor of mortgaged goods, rem0 s or disposes of the<br />

goods without the consent of the mortgagee, and with intent to defraud,<br />

is guilty of a misdemeanour, and is liable to ~prisonment with hard<br />

labour for three years.<br />

<strong>The</strong> term “mortgaged goods” includes any goods and chattels of<br />

any kind, and any live animals, and any progeny of any animals, and<br />

any crops or produce of the earth, whether growing or severed, which<br />

are subject for the time being to the provisions of any written instrument<br />

by which a valid charge or lien is created upon them by way of security<br />

for any debt or obligation.<br />

<strong>The</strong> consent of the mortgagee may be either express or i ~~~ied fro<br />

the nature of the property mortgaged.<br />

408. ~ r a ~ ~ ~ ~ r o ~ fpf r ~ ifpwer. a ~ Any o ~ person t who fraudulently<br />

abstracts or diverts to his own us or to the use of any other person<br />

any mechanical, illuminating, or electrical, power derived from any<br />

machine, apparatus, or substance, the property of another person, is<br />

guilty of a crime, and is liable to imprisonment with hard labour for<br />

three years.<br />

A person who-<br />

(a) unlawfully uses any moltor vehicle, aircraft or vessel without<br />

the consent of the person in lawful polssession thereof; or<br />

(b) has in his possession any motor vehicle, aircraft or<br />

without the consent of the person in lawful possession<br />

with intent to deprive the owner or person in lawful possession<br />

thereof of the use and possession thereof either temporarily<br />

or permanently,<br />

is guilty of a crime and is liable to imprisonment with hard labour for<br />

seven years.<br />

If the offender uses or intends to use the motor vehicle, aircraft OB<br />

vessel for the purpolse of facilitating the commission of an indictable<br />

offence, he is liable to imprisonment with hard labour for ten years.<br />

If the off ender-<br />

(c) wilfully destroys, damages, removes or otherwise interferes<br />

with the mechanism (or part thereof) or other part of or<br />

equipment attached to the motor vehicle, aircraft ~r vessel;<br />

(d) intends to destroy, damage, remove or omthenvise interfere<br />

with the mechanism (or part thereof) or other<br />

equipment attached to the motor vehicle, aircraft os vessel,<br />

he is liable to imprisonment with hard labour for twelve years.<br />

It is a defence to a charge of an offence defined in this subsection<br />

to prove that the accused person had the lawful consent of the owner<br />

of the motor vehicle, aircraft or vessel to its use or possession by the<br />

accused person.
