An <strong>Act</strong> to Amend <strong>The</strong> <strong>Criminal</strong> <strong>Code</strong> and <strong>The</strong> Offenders Probation and<br />

Parole <strong>Act</strong>s 1959 to1 1968, each in certain particulars<br />

[Assented to 25 October, 19711<br />

PART 1-PRELIMINARY<br />

11, Short . This <strong>Act</strong> may be cited as <strong>The</strong> <strong>Criminal</strong> <strong>Code</strong><br />

and the OBenders Probation and Parole <strong>Act</strong> Amendment <strong>Act</strong> 1971.<br />

2. Pa& of <strong>Act</strong>. This <strong>Act</strong> is divided into Parts as follows:-<br />

PART 1-PRELIMINARY;<br />

PART 11-AMENDMENTS OF THE CRIMINAL CODE;<br />

PART 111-AMENDMENTS OF THE OFFENDERS<br />

PAROLE ACTS 1959 TO 1968.<br />

PART 11-AMENDMENTS<br />

OF THE CRIMINAL<br />

PROBATION AND<br />

CODE<br />

3t~ this <strong>Act</strong>) to Wilful ~~~~~~~ A reference<br />

in any <strong>Act</strong> (other than this <strong>Act</strong>), or in any instrument made under any<br />

such <strong>Act</strong>, to-<br />

(a) “wilful murder”;<br />

(b) “wilful murder or murder”;<br />

(c) “wilful murder and murder”; or<br />

(d) “wilful murder, murder”,<br />

shall, unless the context is such that it would be inapprop~ate or the<br />

contrary intention. appears, be read as a refemnce to “murder” and the<br />

<strong>Act</strong> or instrument shall have effect accordingly.<br />

. (1) Where a persoii is charged on indictment with ittl<br />

offence against section 301 of <strong>The</strong> <strong>Criminal</strong> <strong>Code</strong> before the com-<br />

mencement of this <strong>Act</strong> and. the trial on the indictment is continued after<br />

that commencement, the trial shall be continued, and punishment shall be<br />

imposed and enforced upon a conviction in the proceedings, as if this<br />

<strong>Act</strong> had not been passed.<br />

(2) Where before the commencoment of this <strong>Act</strong> a person has<br />

committed an offence against section 301 of <strong>The</strong> <strong>Criminal</strong> <strong>Code</strong> in respect<br />

of which he has not been charged on indictment before that commencement,<br />

he may be charged under section 302 of <strong>The</strong> <strong>Criminal</strong><br />

<strong>Code</strong> as amended by this Part of this <strong>Act</strong> in respect of the act or omission<br />

~~n~tituting the offence as if at the time of doing the act or making the<br />

omission the said section 302 as so amended had been of force and effwt.<br />
