KO. 358.-PIRACY BY THE LAW OF NATIONS.<br />

Common Law.<br />

Irescribe the place as on the h&h seas:--<br />

Piratically assaulted one E.F. and others, mariners, then being on the ship<br />

<strong>The</strong>tis, and put them in fear [or Violently. and piratically assaulted‘one E.F. and<br />

others, mariners, then being on the ship <strong>The</strong>tis], and then took the said ship [or<br />

certain goods then on board of the said ship or part of the tackle (or apparel or<br />

furniture) of the said ship] from the possession of the said mariners, and carried<br />

the same away against the will of the said mariners.<br />

Section 2.<br />

(a,) State the piracg as in prcceding Form, describing the ship as a British<br />

ship, and proceed as‘follozos:-Apd that t/&e said A.B. at the time of [or immedi-<br />

ately before (or after)] committing the said offence assaulted the said E.F. [or<br />

one G.H.], who was then on board of [or then belonged to] the said ship with<br />

;ni,&nt to murder him [or stabbed (or cut or wounded) the said E.F. (or one G.H.),<br />

who was then on board of (or then belonged to) the said ship or Enlawfully (state<br />

the unZawful act done), whereby the life of the said E.F. (or one G.H.), who was<br />

then on board of (or then belonged to) the said ship, was endangered].<br />

(b,) Assaulted one E.F., who was then on board of [or then belonged to] the<br />

British ship <strong>The</strong>tis with intent to murder him [or Stabbed (or Cut or Wounded)<br />

one E.F., who was then on board of (or then belonged to) the British ship <strong>The</strong>tis<br />

or Unlawfully (state the unlawful act), whereby the life of one E.F., who was then<br />

on board of (or then belonged to) the British ship <strong>The</strong>tis was endangered]: And<br />

that the said A.B. committed the unlawful act aforesaid with intent to commit<br />

piracy by piratically assaulting (40. state the ofence intended to be committed,<br />

as in preceding Form, using the participle for the indicative).<br />

(a.) Being a British subject, decoyed one E.F., a native of an island in the<br />

Pacific Ocean, not in the dominions of our said Lady the Queen, nor within the<br />

jurisdiction of any civilised power, for the purpose of importing [or removing]<br />

the said E.F. to an island [or a place] other than that where the said E.F. then<br />

was [or Being a British subject, carried away (or confined or detained) one E.F.<br />

a native (Bc. as above) for the purpose (&e. as above) without his consent].<br />

(b.) Being a British subject, shipped [or embarked or received or detained or<br />

confined or assisted ip shipping (or embarking or receiving or detaining or confining)]<br />

one E.F., a native of (@. as in (a)) on board the ship Carl, for tho<br />

purpose (&e. as in (a)) without the consent of the said E.F.<br />

(0.) Being a British subject, contracted with one M.N. for the shipping [or<br />

embarking or receiving or dletaining or confining] of one E.F., a native (4c. as in<br />

(a)) on board the ship Carl, for the purpose (bc. as in (a)) without the consent<br />

of the said M.N.<br />

(d.) Being a British subject, fitted out [or manned or navigated or equipped<br />

or used or employed or let (or took) on freight (or hire) or conimaniled or served<br />

(or was) oil board of] the ship Carl, with intent to [or with intent that persons<br />
