CRIMINAL CODE s.1 25<br />

<strong>The</strong> term “person” and “owner,” and other like terms, when used<br />

with reference to property, include corporations of all kinds, and any<br />

other associations of persons capable of owning property: <strong>The</strong>y also, when<br />

so used, include Her Majesty;<br />

<strong>The</strong> term ‘‘person employed in the Public Service” includes officers<br />

and men of the Defence Force and police oacers, and persons employed<br />

to execute any process of a court of justice: It also includes the Com-<br />

missioner for Railways, and persons employed by him;<br />

<strong>The</strong> term “police officer” includes any constable or officer of police;<br />

<strong>The</strong> term “Post and Telegraph Department” means the Department<br />

of State charged with the execution of the laws relating to public Posts<br />

and Telegraphs;<br />

<strong>The</strong> term “Postmaster-General” means the Minister charged with the<br />

administration of that ~epartment;<br />

<strong>The</strong> terms “Post Office” and “Telegraph Office,” respectively, mean<br />

and include any structure, room, place, or receptacle, of any kind,<br />

appointed by authority of the Postmaster-General for the receipt, despatch,<br />

or delivery, of anything sent by post or telegraph, or for the transaction<br />

of the business of the Department relating to Posts and Telegraphs<br />

respectively;<br />

T’he term “property” includes every thing, animate or inanimate,<br />

capable of being the subject of ownership;<br />

<strong>The</strong> term “railway” includes every kind of way on which vehicles<br />

are borne upon a rail or rails, whatever may be the means of propulsion;<br />

<strong>The</strong> terms “registered brand” and “registered mark“ mean respec-<br />

tively a brand or mark which is registered under the authority of the<br />

laws relating to brands and each such registered brand or registered mark<br />

shall for the purposes of this <strong>Code</strong> be deemed to be the registered brand<br />

or registered mark respectively of the person in whose name such brand<br />

or mark is registered: Provided that where such brand or mark is<br />

registered in the names of two or more persons such registered brand or<br />

registered mark shall for the purposes of this <strong>Code</strong> be deemed to be<br />

the registered brand or registered mark respectively of each of such<br />

persons;<br />

<strong>The</strong> term “ship” includes every kind of vessel used in navigation<br />

not propelled by oars;<br />

<strong>The</strong> term “summary conviction” means summary conviction before<br />

two justices in petty sessions;<br />

<strong>The</strong> term “telegraph” includes a telephone;<br />

<strong>The</strong> terms “telegram” and “thing sent by telegraph” mean and<br />

include any written or printed or partly written and partly printed<br />

message delivered at a telegraph office or post office for transmission by<br />

electric telegraph, or delivered or prepared for delivery from a telegraph<br />

office or post office as a message transmitted by electric telegraph for<br />

delivery;<br />

<strong>The</strong> term “thing sent by post” includes any letter, newspaper, packet,<br />

parcel, or other thing, authorised by law to be transmitted by post, which<br />

has been posted or received at a post office for delivery or transmission<br />

by post, and which is in course of transmission by post, and any moveable<br />

receptacle which contains any such thing, and which is in course of<br />

transmission by post;
