9. Erection or Lines W ~ A@ t ~<br />

Any person who, without the authority of the Postmaster-General, the<br />

proof of which lies on the person charged-<br />

(1) Sets up, maintains, or uses, a telegraph line on any Crown<br />

lands, or on any public road, street, or highway; or<br />

(2) Knowingly uses a telegraph lime that has been set up in or<br />

on any such lands or place;<br />

and in either case neglects to comply with a notice from the Postmaster-<br />

General to pay such charges, if any, in respect of the line as may from<br />

time to time be fixed by the Governor in Council, is guilty of an offence,<br />

and is liable on summary conviction to a fine of ten dollars for every<br />

day during which the line continues to be so set up, mai~tai~e~, 01- used.<br />

<strong>The</strong> Postmaster-General may at any time authorise any person to<br />

take absolute possession of, and to cut down and destroy, the whole or<br />

any part of any telegraph line that has been set up in or on any such<br />

lands or place.<br />

g Possession of Post 811 cem, etc. Any<br />

person who wilfully obstructs or delays any person duly authorised by<br />

the Postmaster-General to enter into a post office or telegraph office, and<br />

t~ take possession of anything therein which belongs or appertains to. the<br />

Post and Telegraph Department, in so entering or taking possession, or<br />

wilfully interferes with any such person who has SO entered while he is<br />

remaining in the post office or telegraph office, or on the premises where<br />

the post office or telegraph office is situated, for a reasonable time for the<br />

purpose of taking such possession, is guilty of an offence, and is liable on<br />

summary conviction to a fine of forty dollars.<br />

cers. Any person who resists a person employed by<br />

or under the Fost and Telegraph Department while engaged in the execu-<br />

tion of his duty under the laws relating to Posts and Telegraphs is guilty<br />

of an offence, and is liable on summary conviction to imprisonment with<br />

hard labour for three months, or to a fine of forty dollars.<br />

a statement touching any matter is required by law to make it on oath<br />

or under some sanction which may by law be substituted for an oath, or<br />

is required to verify it by solemn declaration or affirmation, makes a<br />

statement touching such matter which, in any material particular, is to<br />

his knowledge false, and verifies it on oath or under such other sanction<br />

or by solemn declaration or affirmation, is guilty of a crime, and is liable<br />

to imprisonment with hard labour for seven years.<br />

<strong>The</strong> offender cannot be arrested without warrant.
