used signifies or implies, or may reasonably induce any per-<br />

son to believe, contrary to the fact, that the article is such as<br />

is designated by the trade mark;<br />

is guilty of a misdemeanour, and is liable to imprisonment with hard<br />

labour for two years, and to be fined at the discretion ofthe Court.<br />

And every thing which he has in his possession to which the trade<br />

mark or counterfeit trade mark has been so applied, and every instru-<br />

ment which he has in his possession by means of which any such mark<br />

has been so applied, or which is intended for applying any such mark, is<br />

forfeited to Her Majesty.<br />

<strong>The</strong> term “trade mark” includes any word or mark of any kind whatever,<br />

which is lawfully used by any person to denote that any article is<br />

of his manufacture, workmanship, production, or merchandise, or is a<br />

thing of a peculiar or ~art~cular description made or sold by him.<br />

<strong>The</strong> term “~ounterfeit” includes any imitation of a genuine mark<br />

which is not genuine and which resembles the genuine mark.<br />

se Te s. Any person who-<br />

(1) Knowingly and without the authority of the pretended sender,<br />

sends or delivers, or causes to be sent or delivered, to any<br />

person employed by or under the Post and Telegraph Department,<br />

for the purpose of being transmitted as a telegram,<br />

a message or writing purporting to be sent by another person;<br />

(2) Signs a telegram in the name of another person without that<br />

person’s authority, or in the name of a fictitious person; or<br />

(3) Wilfully alters a telegram without the authority of the sender;<br />

or<br />

(4) Writes, issues, or delivers, as and for a telegram received<br />

through a telegraph office, a writing purporting to be a<br />

telegram so received, and which is not a telegram so received;<br />

is guilty of an offence, and is liable on summary conviction to imprisonment<br />

with hard labour for twelve months. and to a fine of two hundred<br />

doljars.<br />
