CRIMINAL CODE ss. P12-PP§ 59<br />

C~FS at EIlections. Any person who-<br />

(1) Being a presiding officer at an election, and being called<br />

upon, in the case of an elector who is blind or is unable<br />

to read, to strike out from a ballot-paper the name of the<br />

candidate or candidates other than the candidate or candidates<br />

for whom the elector says that he desires to vote, wilfully<br />

fails to do so In the polling-booth, and in the presence and<br />

sight of the persons then lawfully present; or<br />

eing a presiding officer at an election, and whilst an elector<br />

preparing his ballot-paper in a compartment provided for<br />

the use of electors actually voting, wilfully allows any other<br />

person. to be in the compartment;<br />

is guilty of a misdemeanour, and is liable to imprisonment with har<br />

labour for three years.<br />

election-<br />

(1) ~ilfully makes a false answer to any question which is<br />

lawfully put to him by the presiding officer, and which he is<br />

required by law to answer; or<br />

eing lawfully required to make a declaration before voting,<br />

wilfully makes a false declaration;<br />

is guilty of a crime, and is liable to imprisonment with hard labour for<br />

seven years.<br />

<strong>The</strong> offender cannot be arrested without warrant except by direction<br />

of the presiding officer.<br />

214. ~ ~ ~ Any ~ person ~ o who- ~ § ,<br />

(1) At or after an election, knowingly and wilfully, and without<br />

the lawful command of some competent court or tribunal,<br />

unfastens the fold upon a ballot-paper within wliich. the<br />

nuniber of an elector is written, and which fold has been<br />

made under the authority of the law; or<br />

(2) Being a person required by law to discharge duties at an<br />

election at which the voting is by ballot, attempts to ascertain<br />

or discover, or aids in ascertaining or discovering, the<br />

candidate for whom the vote of any person is given at the<br />

election, except in the case of a person voting openly; or<br />

(3) Having in the exercise of his ofice at an election obtained<br />

knowledge or the means of knowledge of the candidate for<br />

whom any person has voted at the election, discloses or aids<br />

in disclosing such knowledge otherwise than in answer to a<br />

question put in the course of proceedings before some<br />

competent court or tribunal; or<br />

(4) Being a person required by law to discharge duties at an<br />

election, places upon a ballot-paper any mark or writing<br />

not authorised by law;<br />

is guilty of a misdemeanour, and is liable to imprisonment with hard<br />

labour for two years.<br />
