CRIMINAL CODE §S. 420-425 13 1<br />

If the offence is committed in the night, the offender is liable to<br />

imprisonment with hard labour for life.<br />

As amended by <strong>Act</strong> of 1976, No. 25, s. 8.<br />

Any person who enters or is in the dwelling-house of another with intent<br />

to commit an indictable offence therein, is guilty of a crime, and is liable<br />

to imprisonment with hard labour for seven years.<br />

If the offence is committed in the night, the offender is liable to<br />

~~pris5n~ei~t with hard labour for fourteen years.<br />

As amended by <strong>Act</strong> of 1976, No. 25, s. 9.<br />

person who-<br />

(I) breaks and enters a place and commits an indictable offence<br />

therein; or<br />

(2) having committed an indictable offence in any place breaks<br />

out of that place,<br />

4s guilty of a crime and is liable to imprisonment with hard labour for<br />

fourteen years.<br />

22.<br />

Any person who-<br />

(1) breaks and enters a place with intent to commit ala indictable<br />

offence therein; or<br />

(2) having entered any place with intent to commit an indictable<br />

offence therein breaks out of that place,<br />

is guilty of a crime and is liable to imprisonment with hard labour for<br />

seven years.<br />

(a) Being armed with any dangerous or offensive ~~eapo~ or<br />

instrument, and being so armed with intent to break or<br />

enter a dwellinng-house, and to commit an indictable offence<br />

therein;<br />

(b) Being armed as aforesaid by night, and being so armed with<br />

intent to break or enter any building whatever, and to commit<br />

an indictable offence therein;<br />

(e) Having in his possession by night without lawful excuse,<br />

the proof of which lies on him, any instrument sf housebreaking;<br />

(d) Having in his possession by day any such instrument with<br />

intent to commit an indictable offence;<br />

(e) Having his face masked or blackened or being otherwise<br />

disguised, with intent to commit an indictable offence; or
