ea1 Authority-<br />

(1 ) Advisedly applies any money forming part of any fund under<br />

the control of the Local Authority to any purpose to which,<br />

to his knowledge, it cannot lawfully be applied; or<br />

(2) Advisedly concurs in any such application of any such money;<br />

is guilty of a misdemeanour, and is liable to imprisonment with hard<br />

labour for two years.<br />

<strong>The</strong> term ‘‘Local Authority” includes any corporation or board con-<br />

stituted or appointed under the authority of a Statute, and charged with<br />

tbe administration of moneys for any purposes of local concern.<br />

A prosecution for either of the offences defined in this section cannot<br />

be began except by the direction of a Crown Law Officer.<br />

. Any person who, being a clerk or<br />

servant, or being employed or acting in the capacity of a clerk or servant,<br />

does any of the acts following with intent to defraud, that is to say,-<br />

Destroys, alters, mutilates, or falsifies, any book, document,<br />

valuable security, or account, which belongs tu or is in the<br />

possession of his employer, or has been received by him on<br />

account of his employer, or any entry in any such book,<br />

document, or account, or is privy to any such act; or<br />

Makes or is privy to making any false entry in any such<br />

book, document, or account; or<br />

Omits or is privy to omitting any material particular from<br />

any such book, document, or account;<br />

a crime, and is liable to imprisonment with hard labour fur<br />

2. cer. Any person who, being an officer<br />

charged with the receipt, custody, or management of any part of the<br />

public revenue or property, knowingly furnishes any false statement or<br />

return of any money or property received by him or entrusted to his<br />

care, or of any balance of money or property in his possession or under<br />

his control, is guilty of a misdemeanour, and is liable to ~ prison~~n~<br />

with hard labour for two years.<br />

CHAPTER XLIIA-SECRET COMMISSIONS<br />

<strong>The</strong> term “agent” includes any corporation, h, or person acting<br />

or having been acting, or desirous or intending to act, for or on behalf<br />

of any corporation, firm, or person, whether as agent, partner, co-owner,<br />

clerk, servant, employee, banker, broker, auctioneer, architect, clerk of<br />

works, charterer, master mariner, purser, or any member of the crew of<br />

a vessel, engineer, barrister, solicitor, legal practitioner, conveyancer,<br />

surveyor, buyer, salesman, foreman, trustee, official assignee, executor,<br />

administrator, liquidator, trustee in bankruptcy or of a deed of assign-<br />

ment, receiver, director, manager, or other officer or member of the<br />

committee or governing body of any corporation, club, partnership, or<br />

association, or in any other capacity, either alone or jointly with any other<br />

corporation, firm, or person, and whether in his own name or in the name<br />

of his principal or otherwise: the term also includes a Minister of the<br />

Crown, and a person serving under the Crown or a Minister of the Crown,
