427A* ws. ( 1) Any person<br />

who obtains fro ttel, money or valuable security<br />

by passing a cheque that is not paid on presentation for payment is<br />

guilty of a misdemeanour and is liable to imprisonment with hard labour<br />

for two years.<br />

(2) It is a defence to a charge of an offence defined in his section<br />

to prove that the accused person-<br />

(a) had reasonable grounds for believing that the cheque would<br />

be paid in full on presentation fox payment; and<br />

(b) had no intent to defraud.<br />

(3) <strong>The</strong> fact that at the time when the cheque was passed there<br />

were some funds to the credit of the account on which the cheque was<br />

drawn is not of itself a defence to a charge of an offence d<br />

this section.<br />

(4) A prosecution for an offeiice defined in this section shall not be<br />

commmced without the consent of a Crown Law Officer.<br />

wi~full~ false promise or partly by a false pretence and partly by a wilfully<br />

false promise, and with intent to defraud, induces any person to execute,<br />

make, accept, indorse, alter, cx destroy, the whole or any part of any<br />

valuable security, or to write, impress, or affix, any name or seal upon<br />

or to any paper or parchment, in order that it may be alterwards made<br />

or converted into or used or dealt with as il valuable security, is guilty of<br />

a crime and is liable to imprisonment with hard labour for three years.<br />

<strong>The</strong> offender cannot be arrested without warrant unless found committing<br />

the offence.<br />

e Any person who by means of army fraudul~n~ trick or<br />

from any other person anyth~n~ capable of being stolen,<br />

or induces any other person to deliver to any person anything capable of<br />

being stolen, ox to pay or deliver lo any person any money or goods,<br />

m of money or greater quantity of goods than he would<br />

ivered but for such trick or device, is guilty of a miss<br />

liable to imprisonment with hard labour for two years.<br />

Any person who, being<br />

a seller or mortgagor of any property, or being the solicitor or agent of<br />

any such seller or mortgagor, with intent to induce the purchaser or<br />

mortgagee to accept the title offcred or produced to him, and with intent<br />

to defraud-<br />

(1) Conceals from the purchaser or mortgagee any insmrnent<br />

material to the title, or any ~ nc~~~rance; or
