§420.14(b)).<br />

The United States (U.S.) Environmental Protection Agency (EPA) initiated consultation<br />

with NMFS on its proposal to authorize use, pursuant to the Federal Insecticide,<br />

Fungicide, <strong>and</strong> Rodenticide Act (FIFRA), 7 U.S.C. 136 et seq., of pesticide products<br />

containing the a.i.s (a.i.s) of carbaryl, <strong>and</strong> methomyl on April 1, 2003, <strong>and</strong> of carbofuran<br />

on December 1, 2004. EPA authorization of pesticide uses are categorized as FIFRA<br />

sections 3 (new product registrations), 4 (reregistrations <strong>and</strong> special review), 18<br />

(emergency use), or 24(c) [Special Local Needs (SLN)]. At that time, EPA determined<br />

that uses of pesticide products containing these ingredients “may affect” most of the 26<br />

Evolutionarily Significant Units (ESUs) of Pacific salmonids listed as endangered or<br />

threatened <strong>and</strong> designated critical habitat for the ESUs. This document represents<br />

NMFS’ biological opinion (Opinion) on the impacts of EPA’s authorization of pesticide<br />

products containing the above-mentioned a.i.s on the listed ESUs, plus on two newly<br />

listed salmonids. This is a partial consultation because pursuant to the court’s order, EPA<br />

sought consultation on only this group of listed species under NMFS’ jurisdiction.<br />

However, even though the court’s order did not address the two more recently listed<br />

salmonids, NMFS analyzed the impacts of EPA’s action to them because they belong to<br />

the same taxon. NMFS analysis requires consideration of the same information.<br />

Consultation with NMFS will be completed when EPA makes effect determinations on<br />

all remaining species <strong>and</strong> consults with NMFS as necessary.<br />

This Opinion is prepared in accordance with section 7(a)(2) of the ESA <strong>and</strong><br />

implementing regulations at 50 CFR §402. However, consistent with the decision in<br />

Gifford Pinchot Task Force v. USFWS, 378 F.3d 1059 (9 th Cir. 2004), we did not apply<br />

the regulatory definition of “destruction or adverse modification of critical habitat” at 50<br />

CFR §402.02. Instead, we relied on the statutory provisions of the ESA to complete our<br />

analysis of the effects of the action on designated critical habitat.<br />
