affect but is not likely to adversely affect” 18 ESUs, <strong>and</strong> “may affect” 3 ESUs of listed<br />

salmonids. EPA’s “no effect” determinations applied to the California Coastal Chinook<br />

salmon, Central California coho salmon, <strong>and</strong> Northern California steelhead.<br />

On June 28, 2005, NMFS listed the Lower Columbia River coho salmon ESU as<br />

endangered. Given this recent listing, EPA’s 2003 <strong>and</strong> 2004 effects determinations for<br />

carbaryl, carbofuran, <strong>and</strong> methomyl on listed Pacific salmonids lack an effects<br />

determination for the Lower Columbia River coho salmon.<br />

On May 22, 2007, NMFS listed the Puget Sound Steelhead Distinct Population Segment<br />

(DPS) as threatened. Given this recent listing, EPA’s 2003 <strong>and</strong> 2004 effects<br />

determinations for carbaryl, carbofuran, <strong>and</strong> methomyl on listed Pacific salmonids lack<br />

an effects determination for the Puget Sound steelhead.<br />

On December 10-12, 2007, EPA <strong>and</strong> the Services met <strong>and</strong> discussed approaches for<br />

moving forward with ESA consultations <strong>and</strong> pesticide registrations. The agencies agreed<br />

to develop methodologies for filling existing data gaps. In the interim, the Services will<br />

develop approaches within their Opinions to address these gaps. The agencies identified<br />

communication <strong>and</strong> coordination mechanisms to address technical <strong>and</strong> policy issues <strong>and</strong><br />

procedures for conflict resolution.<br />

On February 11, 2008, NMFS listed the Oregon Coast coho salmon ESU as threatened.<br />

EPA’s 2003 <strong>and</strong> 2004 initiation packages for carbaryl, carbofuran, <strong>and</strong> methomyl<br />

provided an effects determination for the Oregon Coast coho salmon ESU. This ESU<br />

was previously listed in 1998 <strong>and</strong> its ESA status was in-flux until 2008.<br />

On August 20, 2008, NMFS met with EPA <strong>and</strong> requested EPA to identify applicants for<br />

this <strong>and</strong> subsequent pesticide consultations. NMFS also requested information on EPA’s<br />

cancellation of carbofuran <strong>and</strong> of existing stocks of carbofuran.<br />
