Conservation Recommendations<br />

Section 7(a) (1) of the ESA directs federal agencies to use their authorities to further the<br />

purposes of the ESA by carrying out conservation programs for the benefit of endangered <strong>and</strong><br />

threatened species. Conservation recommendations are discretionary agency activities to<br />

minimize or avoid adverse effects of a proposed action on listed species or critical habitat, to<br />

help implement recovery plans, or to develop information.<br />

The following conservation recommendations would provide information for future<br />

consultations involving future authorizations of pesticide a.i.s that may affect listed species:<br />

1. Conduct mixture toxicity analysis in screening-level <strong>and</strong> endangered species biological<br />

evaluations;<br />

2. Develop models to estimate pesticide concentrations in off-channel habitats; <strong>and</strong><br />

3. Develop models to estimate pesticide concentrations in aquatic habitats associated with<br />

non-agricultural applications, particularly in residential <strong>and</strong> industrial environments.<br />

In order for NMFS to be kept informed of actions minimizing or avoiding adverse effects or<br />

benefiting listed species or their habitats, the EPA should notify NMFS OPR of any conservation<br />

recommendations it implements in the final action.<br />

Reinitiation Notice<br />

This concludes formal consultation on the EPA’s proposed registration of pesticide products<br />

containing carbaryl, carbofuran, <strong>and</strong> methomyl <strong>and</strong> their formulations to ESA-listed Pacific<br />

salmonids under the jurisdiction of the NMFS. As provided in 50 CFR 402.16, reinitiation of<br />

formal consultation is required where discretionary federal agency involvement or control over<br />

the action has been retained (or is authorized by law) <strong>and</strong> if: (1) the extent of take specified in the<br />

Incidental Take Statement is exceeded; (2) new information reveals effects of this action that<br />

may affect listed species or designated critical habitat in a manner or to an extent not previously<br />

considered in this biological opinion; (3) the identified action is subsequently modified in a<br />

manner that causes an effect to the listed species or critical habitat that was not considered in this<br />

Opinion; or (4) a new species is listed or critical habitat designated that may be affected by the<br />

identified action. If reinitiation of consultation appears warranted due to one or more of the<br />

above circumstances, EPA must contact NMFS OPR. If none of these reinitiation triggers are<br />
