102 Damage to Property or to<br />

Labour laws:<br />

CONTRACTOR shall also carry and maintain any and all<br />

other insurance(s) which he may be required under any<br />

law or regulation from time to time without any extra cost to<br />

EMPLOYER. He shall also carry and maintain any other<br />

insurance which may be required by the EMPLOYER.<br />

102.1 i) CONTRACTOR shall be responsible for making good to<br />

the satisfaction of the EMPLOYER any loss or any<br />

damage to structures and properties belonging to the<br />

EMPLOYER or being executed or procured or being<br />

procured by the EMPLOYER or of other agencies within in<br />

the premises of all the work of the EMPLOYER, if such<br />

loss or damage is due to fault and/or the negligence or<br />

willful acts or omission of the CONTRACTOR, his<br />

employees, agents, representatives or<br />

SUB-CONTRACTORs.<br />

ii) The CONTRACTOR shall take sufficient care in moving<br />

his plants, equipments and materials from one place to<br />

another so that they do not cause any damage to any<br />

person or to the property of the EMPLOYER or any third<br />

party including overhead and underground cables and in<br />

the event of any damage resulting to the property of the<br />

EMPLOYER or of a third party during the movement of the<br />

aforesaid plant, equipment or materials the cost of such<br />

damages including eventual loss of production, operation<br />

or services in any plant or establishment as estimated by<br />

the EMPLOYER or ascertained or demanded by the third<br />

party shall be borne by the CONTRACTOR. Third party<br />

liability risk shall be Rupees One lakh for single accident<br />

and limited to Rupees Ten lakhs.<br />

iii) The CONTRACTOR shall indemnify and keep the<br />

EMPLOYER harmless of all claims for damages to<br />

property other than EMPLOYER's property arising under<br />

or by reason of this agreement, if such claims result from<br />

the fault and/or negligence or willful acts or omission of the<br />

CONTRACTOR, his employees, agents, representative of<br />

SUB-CONTRACTOR.<br />

SECTION-VIII Labour Laws<br />

103.1 i) No labour below the age of 18 (eighteen) years shall be employed<br />

on the WORK.<br />

ii) The CONTRACTOR shall not pay less than what is provided<br />

under law to labourers engaged by him on the WORK.<br />

iii) The CONTRACTOR shall at his expense comply with all labour<br />

laws and keep the EMPLOYER indemnified in respect thereof.<br />

iv) The CONTRACTOR shall pay equal wages for men and women<br />

in accordance with applicable labour laws.<br />

v) If the CONTRACTOR is covered under the Contract labour<br />

(Regulation and Abolition) Act, he shall obtain a licence from<br />

licensing authority (i.e. office of the labour commissioner) by<br />

payment of necessary prescribed fee and the deposit, if any,<br />

before starting the WORK under the CONTRACT. Such<br />

fee/deposit shall be borne by the CONTRACTOR.<br />
