FMS - GAIL

1.2 DURATION OF CONTRACT
The FMS / MSS Service agreement shall be signed initially for a
period of one year between GAIL and the Contractor. FMS / MSS
services agreement will effective at respective sites from the
mutually agreed dates, as decided by respective site IT In-charge,
with in a period of one month from date of release of Fax of Indent
to the contractor. The validity / closing date for FMS / MSS contract
shall be the same for all locations.
However, Contract period may be further extended, prior to the expiry of
the contract for another year in the spell of months, at the same rates,
terms and conditions depending on performance of service provider, at the
sole discretion of GAIL.
1.3 PERFORMANCE
The Contractor should be a total solution provider, responsible to carry out
Comprehensive Systems Maintenance Support Services (MSS) and Facility
Management Services (FMS) for IT Infrastructure, covered under Scope of
work. The Contractor shall undertake to perform all services under this
contract with all reasonable skill, diligence and care in accordance with
sound industry practices to the satisfaction of the GAIL and accept full
responsibility for the satisfactory quality of such services as performed by
them. Any defect or deficiencies noticed in the contractor services will be
promptly remedied by the contractor with in seven calendar days upon the
receipt of written notice from GAIL to improve their performance failing
which GAIL may terminate the Contract by giving the contractor 30 days
written notice. Contractor has to submit Performance Bank Guarantee
(PBG), equivalent to 10% of the contract value irrespective of
commencement date of FMS & MSS services, as per GAIL General condition
of contract (GCC). PBG Value shall exclude the amount quoted for supply of
UPS batteries, printer consumables, LAN Cabling items, other optional
items and supply/services for repair of cut of OFC segments of the SOR
(Table ‘I’, ‘J’ &’ K’). Contractor shall ensure that PBG shall be valid for a
period of 15 months from date of signing of contract or up to extended
period of contract, which ever date is later.
1.4 SAFETY & INDUSTRIAL / LABOUR LAWS
The Contractor shall comply with the provision of all laws including Labor
laws, rules, regulations and notifications issued there under from time to
time. All safety and labor laws enforced by statutory agencies and by GAIL
shall be applicable in the performance of this Contract and the Contractor
shall abide by these laws. Following labor legislations shall be complied by
the Contractor during execution of the contract:-
1.4.1 Contractor shall obtain & shall abide by all necessary licenses /
permissions from the concerned authorities as provided under the
various labor legislations including the labor license obtained as
per provision of the Contract labor (Regulation & Abolition) Act-
1970.
