contractors and other<br />

agencies:<br />

responsibility of the CONTRACTOR executing the work of civil<br />

construction, to work in close cooperation and coordinate the WORK<br />

with the Mechanical, Electrical, Air-conditioning and<br />

Intercommunication Contractor's and other agencies or their<br />

authorised representatives, in providing the necessary grooves,<br />

recesses, cuts and opening etc., in wall, slabs beams and columns<br />

etc. and making good the same to the desired finish as per<br />

specification, for the placement of electrical, intercommunication<br />

cables, conduits, air-conditioning inlets and outlets grills and other<br />

equipments etc. where required. For the above said requirements in<br />

the false ceiling and other partitions, the CONTRACTOR before<br />

starting-up the work shall in consultation with the Electrical,<br />

Mechanical, Intercommunication, Air-conditioning contractor and<br />

other agencies prepare and put-up a joint scheme, showing the<br />

necessary openings, grooves, recesses, cuts, the methods of fixing<br />

required for the WORK of the aforesaid, and the finishes therein, to<br />

the ENGINEER-IN-CHARGE and get the approval. The<br />

CONTRACTOR before finally submitting the scheme to the<br />

ENGINEER-IN-CHARGE, shall have the written agreement of the<br />

other agencies. The ENGINEER- IN-CHARGE, before<br />

communicating his approval to the scheme, with any required<br />

modification, shall get the final agreement of all the agencies, which<br />

shall be binding. No claim shall be entertained on account of the<br />

above.<br />

The CONTRACTOR shall confirm in all respects with provision of<br />

any statutory regulations, ordinances or byelaws of any local or duly<br />

constituted authorities or public bodies which may be applicable from<br />

time to time to the WORK or any temporary works. The<br />

CONTRACTOR shall keep the EMPLOYER indemnified against all<br />

penalties and liabilities of every kind, arising out of non- adherance to<br />

such stains, ordinances, laws, rules, regulations, etc.<br />

40 Other agencies at site: 40.1 The CONTRACTOR shall have to execute the WORK in such place<br />

and conditions where other agencies will also be engaged for other<br />

works such as site grading, filling, and levelling, electrical and<br />

mechanical engineering works, etc. No claim shall be entertained<br />

due to WORK being executed in the above circumstances.<br />

41.1 TO THE CONTRACTOR:<br />

Any notice hereunder may be served on the CONTRACTOR or his<br />

duly authorised representative at the job site or may be served by<br />

registered mail direct to the address furnished by the<br />

CONTRACTOR. Proof of issue of any such notice could be<br />

conclusive of the CONTRACTOR having been duly informed of all<br />

contents therein.<br />

41.2 TO THE EMPLOYER:<br />

Any notice to be given to the EMPLOYER under the terms of the<br />

CONTRACTOR shall be served by sending the same by Registered<br />

mail to or delivering the same at the respective site offices of M/S.<br />

<strong>GAIL</strong> (INDIA) LTD. addressed to the HEAD/SITE-IN-CHARGE.<br />

42.1 i) The EMPLOYER reserves the right to distribute the work<br />

between more than one agency(ies). The CONTRACTOR<br />

shall cooperate and afford other agency(ies) reasonable<br />

opportunity for access to the WORK for the carriage<br />

and storage of materials and execution of their works.<br />

ii) Wherever the work being done by any department of the<br />

EMPLOYER or by other agency(ies) employed by the<br />
