10.3 Monthly/Weekly construction programme will; be drawn up by the<br />

ENGINEER-IN-CHARGE jointly with the CONTRACTOR, based on<br />

availability of work fronts and the joint construction programme as per<br />

10.2 above. The CONTRACTOR shall scrupulously adhere to these<br />

targets /programmes by deploying adequate personnel, construction<br />

tools and tackles and he shall also supply himself all materials of his<br />

scope of supply in good time to achieve the targets/programmes. In all<br />

matters concerning the extent of targets set out in the weekly and<br />

monthly programmes and the degree of achievements the decision of<br />

the ENGINEER-IN-CHARGE will be final and binding on the<br />

CONTRACTOR.<br />

11 Tenderer’s Responsibility 11.1 The intending tenderers shall be deemed to have visited the SITE and<br />

familiarised submitting the tender. Non-familiarity with the site<br />

conditions will not be considered a reason either for extra claims or for<br />

not carrying out the works in strict conformity with the DRAWINGS and<br />

SPECIFICATIONS or for any delay in performance.<br />

12 Retired Government or<br />

Company Officers<br />

12.1 No Engineer of Gazetted rank or other Gazetted Officer employed in<br />

Engineering or Administrative duties in an Engineering Department of<br />

the States/ Central Government or of the EMPLOYER is allowed to<br />

work as a CONTRACTOR for a period of two years after his retirement<br />

from Government Service, or from the employment of the EMPLOYER<br />

without the previous permission of the EMPLOYER. The CONTRACT,<br />

if awarded, is liable to be cancelled if either the CONTRACTOR or any<br />

of his employees is found at any time to be such a person, who has<br />

not obtained the permission of the State/Central Government or of the<br />

EMPLOYER as aforesaid before submission of tender, or engagement<br />

in the CONTRACTOR'S service as the case may be.<br />

13 Signing of the Contract: 13.1 The successful tenderer shall be required to execute an AGREEMENT<br />

in the proforma attached with TENDER DOCUMENT within 15 days of<br />

the receipt by him of the Notification of Acceptance of Tender. In the<br />

event of failure on the part of the successful tenderer to sign the<br />

AGREEMENT within the above stipulated period, the Earnest Money<br />

or his initial deposit will be forefeited and the acceptance of the tender<br />

shall be considered as cancelled.<br />

14.1 The field management will be the responsibility of the<br />

ENGINEER-IN-CHARGE, who will be nominated by the EMPLOYER.<br />

The ENGINEER-IN-CHARGE may also authorise his representatives<br />

to assist in performing his duties and functions.<br />

14.2 The ENGINEER-IN-CHARGE shall coordinate the works of various<br />

agencies engaged at site to ensure minimum disruption of work carried<br />

out by different agencies. It shall be the responsibility of the<br />

CONTRACTOR to plan and execute the work strictly in accordance<br />

with site instructions to avoid hindrance to the work being executed by<br />

other agencies.<br />

15.1 The Schedule of Rates should be read in conjunction with all the other<br />

sections of the tender.<br />

15.2 The tenderer shall be deemed to have studied the DRAWINGS,<br />

SPECIFICATIONS and details of work to be done within TIME<br />

SCHEDULE and to have aquainted himself of the condition prevailing<br />

at site.<br />

15.3 Rates must be filled in the Schedule of Rates of original Tender<br />

Documents. If quoted in separate typed sheets no variation in item<br />

description or specification shall be accepted. Any exceptions taken by<br />
