of the receipt by him of the Notification of Acceptance of Tender.<br />
Note: The Earnest Money of the unsuccessful bidder will be returned<br />
by EMPLOYER/CONSULTANT, directly to the tenderer (s), within<br />
a reasonable period of time but not later than 30 days after the<br />
expiration of the period of bid validity prescribed by EMPLOYER.<br />
7 Validity: 7.1 Tender submitted by tenderers shall remain valid for acceptance for a<br />
period of "4 MONTHS" from the date of opening of the tender. The<br />
tenderers shall not be entitled during the said period of 4 months,<br />
without the consent in writing of the EMPLOYER, to revoke or cancel<br />
his tender or to vary the tender given or any term thereof. In case of<br />
tender revoking or canceling his tender or varying any term in regard<br />
thereof without the consent of EMPLOYER in writing, the EMPLOYER<br />
shall forfeit Earnest Money paid by him alongwith tender.<br />
8 Addenda/Corrigenda 8.1 Addenda/ Corrigenda to the Tender Documents will be issued in<br />
duplicate prior to the date of opening of the tenders to clarify<br />
documents or to reflect modification in design or CONTRACT terms.<br />
9 Right of Employer to<br />
Accept or Reject Tender:<br />
8.2 Each addenda/ corrigendum issued will be issued in duplicate to each<br />
person or organisation to whom set of Tender Documents has been<br />
issued. Recipient will retain tenderer's copy of each<br />
Addendum/Corrigendum and attach original copy duly signed along<br />
with his offer. All Addenda/Corrigenda issued shall become part of<br />
Tender Documents.<br />
9.1 The right to accept the tender will rest with the EMPLOYER. The<br />
EMPLOYER, however, does not bind himself to accept the lowest<br />
tender, and reserves to itself the authority to reject any or all the<br />
tenders received without assigning any reason whatsoever. At the<br />
option of the Employer, the work for which the tender had been invited,<br />
may be awarded to one Contractor or split between more than one<br />
bidders, in which case the award will be made for only that part of the<br />
work, in respect of which the bid has been accepted. The quoted rates<br />
should hold good for such eventualities.<br />
Tenders in which any of the particulars and prescribed information are<br />
missing or are incomplete in any respect and/or the prescribed<br />
conditions are not fulfilled are liable to be rejected. The Tender<br />
containing uncalled for remarks or any additional conditions are liable<br />
to be rejected.<br />
Canvassing in connection with tenders is strictly prohibited and<br />
tenders submitted by the Tenderers who resort to canvassing will be<br />
liable to rejection.<br />
10 Time Schedule 10.1 The WORK shall be executed strictly as per the TIME SCHEDULE<br />
specified in TENDER/CONTRACT Document. The period of<br />
construction given in Time Schedule includes the time required for<br />
mobilisation as well as testing, rectifications if any, retesting and<br />
completion in all respects to the entire satisfaction of the<br />
ENGINEER-IN- CHARGE.<br />
10.2 A joint programme of execution of the WORK will be prepared by the<br />
ENGINEER-IN-CHARGE and CONTRACTOR based on priority<br />
requirement of this project. This programme will take into account the<br />
time of completion mentioned in 10.1 above and the time allowed for<br />
the priority works by the ENGINEER-IN-CHARGE.<br />
