1.5 BIDDER’s RESPONSIBILITIES<br />
1.5.1 The bidder should be a total solution provider and shall cover the<br />
total scope of the Contract. The bidder shall ensure availability of all<br />
technical expertise, manpower resources, availability of spare parts,<br />
logistics support etc. and all the expenses incurred for the same will be<br />
borne by the Bidder.<br />
1.5.2 Contractor shall undertake to perform the services with the highest<br />
standards of professional and ethical competence and integrity. For the<br />
purpose of regulating the services under this agreement, the classification<br />
of severity levels of the hardware/network problems have been categorized<br />
in the document.<br />
1.5.3 The successful bidder would provide all the service through the<br />
manpower deployed from their own company. However, technical support<br />
for any specialized work (like cabling work, L3-L4 level support from<br />
respective OEMs or their authorized channel partners) can be agreed with<br />
prior permission from <strong>GAIL</strong>. Further, this exception shall be applied to the<br />
very specialized work as mentioned above and for all other requirements<br />
like deployment and day-to-day operations, the manpower shall be used<br />
from the Contractor regular personnel only. The Contractor will be solely<br />
responsible to ensure compliance of all obligations under the contract.<br />
1.5.4 The bidder should confirm unconditional acceptance of full<br />
responsibility of executing the “Scope of Work” of the Tender. This<br />
confirmation should be submitted by the bidder alongwith technocommercial<br />
bid.<br />
1.5.5 Bidder must identify Project Manager for entire project execution,<br />
management and regular liaison / discussions with <strong>GAIL</strong> on regular basis.<br />
1.5.6 To have the technical skills verified and build confidence on the<br />
manpower being placed at sites, <strong>GAIL</strong> at their descrition can have interview<br />
arranged for the manpower (locally) that Contractor shall be positioning in<br />
<strong>GAIL</strong> and accordingly, <strong>GAIL</strong> can choose those who gets qualified.<br />
1.5.7 <strong>GAIL</strong>, at its sole discretion, if determine that the services are not<br />
being performed satisfactorily or that any security rules, standards,<br />
guidelines, policies, or procedures are not being followed, <strong>GAIL</strong> shall inform<br />
Contractor of the same. After being informed, Contractor shall take within<br />
the mutually agreed time period such steps as necessary and appropriate<br />
to remedy the situation, including, but not limited to, replacing individuals<br />
who have been assigned for rendering the services.<br />
1.5.8 Neither Contractor nor any employee of the Contractor or any<br />
individual assigned by Contractor shall deem to be an employee of <strong>GAIL</strong> for<br />
any purpose whatsoever. In conformance with and without limitation on<br />
any application of the foregoing statement, Contractor shall be solely<br />
responsible for payment of compensation and any other costs attendant to<br />
employment of Contractor, employees, including any amounts that may be<br />
due as prevailing wage under applicable law to Contractor employees<br />
assigned to perform services. Contractor will furnish <strong>GAIL</strong> with a written<br />
declaration that payments of all statuary obligations have been/ will be<br />
made. Such a declaration shall accompany the payment requests made by<br />
Contractor.<br />
