1.12 OPERATION OF THE CONTRACT<br />
The contractor shall commence MSS & <strong>FMS</strong> services within 30 days from date<br />
of issue of FOI. All the payments will become due to the Contractor from the<br />
date of the commencement of the operation of the facility at respective sites,<br />
as mentioned in the document.<br />
The Contract at respective sites shall come into effect after signing of joint<br />
inspection report by <strong>GAIL</strong> site IT / Engineer-In-Charge and representative of<br />
Contractor and satisfying IT In-charge of respective location regarding<br />
qualification and experience of the engineers to be deployed, the stock of<br />
spares and standby / substitute equipments.<br />
The contract shall be entered into for all the <strong>GAIL</strong> offices by the corporate<br />
office. As such after fixing the rates, terms and conditions of the contract by<br />
corporate office, the respective BIS Engineer In-charges shall operate the<br />
contract and recommand the quarterly payment on the basis of the terms &<br />
conditions of the contract. List of IT / Engineer In-charge’s of respective site<br />
offices has been provided at Annexure – “E”.<br />
1.13 EXCLUSIONS FROM THE CONTRACT<br />
Unless specifically mentioned, the maintenance charges shall not cover the<br />
supply and replacement of following consumables listed below:<br />
- Print Bands, Printer Ribbons, Printer heads of DMP, Pen drives<br />
- Toner Cartridges of Laser Printer, Cartridges for Ink / Desk Jet Printers<br />
- Maintenance kit / Drum kit for Color Laser Jet Printers<br />
- Media like DVDs / CDs / DATs / DLTs/ Floppy disks.<br />
- Batteries for UPS & Batteries for Laptop.<br />
All other items other than those explicitly mentioned above, shall be covered<br />
under the comprehensive Maintenance Support Services by the Contractor.<br />
1.14 DELETION OF VARIOUS GCC CLAUSES<br />
The General Conditions of Contract (GCC) is modified to the extent<br />
mentioned below :<br />
1.14.1 Clauses in the General Conditions of Contract (GCC), Section – III of<br />
the tender documjent pertaining to specifically to construction jobs i.e. clause<br />
nos. 2.1 b, 2.3, 2.4.1, 2.4.2, 2.4.5, 2.4.6, 2.4.7, 2.4.9, 2.4.10. 2.4.11. 2.5,<br />
27.339, 40, 57, 59, 61, 62, 63, 64, 65, 69, 70, 82, 86, 112, 113, 114, 115,<br />
116, 117, 118, 119, 120, 121 of GCC stands deleted.<br />
1.15 TERMINATION OF CONTRACT<br />
1.15.1 The Contract can be terminated fully or partly at any time during<br />
the currency of the contract by giving 30 days notice by <strong>GAIL</strong> in writing. <strong>GAIL</strong><br />
reserves the right to terminate the Contract in toto or in parts any time during<br />
the currency of the contract in case of consistent / habitual faults by the<br />
Contractor in attending to and resolving the reported problems / not meeting<br />
the SLR or not adhering to any agreed terms/conditions of Contract.<br />
