esponsible agent duly accredited in writing, present for the<br />

purpose. Orders given to the CONTRACTOR's agent shall be<br />

considered to have the same force as if they had been given to the<br />

CONTRACTOR himself. The CONTRACTOR shall give not less<br />

than seven days notice in writing to the ENGINEER-IN-CHARGE<br />

before covering up or otherwise placing beyond reach of inspection<br />

and measurement of any work in order that the same may be<br />

inspected and measured. In the event of breach of above the same<br />

shall be uncovered at CONTRACTOR's expense for carrying out<br />

such measurement or inspection.<br />

73.2 No material shall be despatched from the CONTRACTOR's stores<br />

before obtaining the approval in writing of the Engineer-in-Charge.<br />

The CONTRACTOR is to provide at all time during the progress of<br />

the WORK and the maintenance period, proper means of access<br />

with ladders, gangways etc. and the necessary attendance to move<br />

and adopt as directed for inspection or measurements of the WORK<br />

by the ENGINEER- IN-CHARGE.<br />

73.3 The CONTRACTOR shall make available to the ENGINEER-IN-<br />

CHARGE free of cost all necessary instruments and assistance in<br />

checking or setting out of WORK and in the checking of any WORK<br />

made by the CONTRACTOR for the purpose of setting out and<br />

taking measurements of WORK.<br />

74 Tests for quality of work: 74.1 All workmanship shall be of the respective kinds described in the<br />

CONTRACT DOCUMENTS and in accordance with the instructions<br />

of the ENGINEER-IN-CHARGE and shall be subjected from time to<br />

time to such test at CONTRACTOR's cost as the<br />

ENGINEER-IN-CHARGE may direct at the place of manufacture or<br />

fabrication or on the site or at all or any such places. The<br />

CONTRACTOR shall provide assistance, instruments, labour and<br />

materials as are normally required for examining, measuring and<br />

testing any workmanship as may be selected and required by the<br />

ENGINEER-IN-CHARGE.<br />

74.2 All the tests that will be necessary in connection with the execution<br />

of the WORK as decided by the ENGINEER- IN-CHARGE shall be<br />

carried out at the field testing laboratory of the EMPLOYER by<br />

paying the charges as decided by the EMPLOYER from time to<br />

time. In case of non- availability of testing facility with the<br />

EMPLOYER, the required test shall be carried out at the cost of<br />

CONTRACTOR at Government or any other testing laboratory as<br />

directed by ENGINEER-IN-CHARGE.<br />

74.3 If any tests are required to be carried out in conjunction with the<br />

WORK or materials or workmanship not supplied by the<br />

CONTRACTOR, such tests shall be carried out by the<br />

CONTRACTOR as per instructions of ENGINEER-IN-CHARGE and<br />

cost of such tests shall be reimbursed by the EMPLOYER.<br />

75 Samples for approval: 75.1 The CONTRACTOR shall furnish to the ENGINEER-IN-CHARGE<br />

for approval, when requested or if required by the specifications,<br />

adequate samples of all materials and finished to be used in the<br />

WORK. Such samples shall be submitted before the WORK is<br />

commenced and in ample time to permit tests and examinations<br />

thereof. All materials furnished and finishes applied in actual<br />

WORK shall be fully equal to the approved samples.<br />

76 Action and compensation in<br />

case of bad work:<br />

76.1 If it shall appear to the ENGINEER-IN-CHARGE that any work has<br />

been executed with unsound, imperfect or unskilled workmanship,<br />

or with materials of any inferior description, or that any materials or<br />

articles provided by the CONTRACTOR for the execution of the<br />
