CITY OF NORMANSEIZURES AND RESTITUTION FUNDBUDGETHIGHLIGHTSBackgroundThe Seizures and Restitution Fund is a Special Revenue Fund used to account for therevenue available through property seizures resulting from criminal investigations.There are three basic sources <strong>of</strong> revenue available, two <strong>of</strong> which are controlled by theCleveland County District Attorney and one controlled by the U.S. Federal Government.Property that is seized by local enforcement <strong>of</strong>ficers is ultimately disposed <strong>of</strong> by courtrulings. The property, including cash, is remanded to the District Attorney if the case does notinvolve federal laws. The District Attorney disposes <strong>of</strong> the non-cash property through an auctionand deposits the proceeds into a revolving account. Periodically, distributions are made from therevolving account to municipalities.The Courts also require restitution by defendants to law enforcement agencies for costsassociated with an investigation. The restitution is made directly to the <strong>City</strong> and placed into thisFund.The Courts remand property and cash seized through Federal cases to the FederalGovernment. If local law enforcement <strong>of</strong>ficers were involved in the case, they may makeapplication to the Federal Government to recover property to <strong>of</strong>fset the cost <strong>of</strong> their investigation.State and Federal statutes provide that monies derived from these sources will be used tosupport drug enforcement activities and other criminal investigations.<strong>FYE</strong> <strong>14</strong> <strong>Budget</strong>Expenditures for maintenance and operation are proposed at $112,629 on revenues <strong>of</strong>$56,007. This fund accounts for a portion <strong>of</strong> an Assistant <strong>City</strong> Attorney’s compensation for timespent on Juvenile Services. Beginning in <strong>FYE</strong> 12, this will be charged directly to the appropriatefunds instead <strong>of</strong> Interfund Transfers.Available revenues from fund balance are proposed to be drawn-down for capital needs tobe used in enforcement activities. No capital equipment needs are projected for <strong>FYE</strong> <strong>14</strong> – <strong>FYE</strong> 18.ANNUAL BUDGET71
