CITY OF NORMANCLEET FUNDBUDGETHIGHLIGHTSBackgroundThe CLEET (Council on Law Enforcement Education and Training) Fund is a SpecialRevenue Fund established to account for revenue derived by provision <strong>of</strong> State law, to be utilizedfor law enforcement education and training. (Title 20 § 1313.2-1313.4)State law provides that any person convicted <strong>of</strong> an <strong>of</strong>fense punishable by a fine <strong>of</strong> $10 ormore, or by incarceration, excluding parking and standing violations, or any person forfeiting bondwhen charged with such an <strong>of</strong>fense, shall be ordered by the court to pay $9, as a separate penaltyassessment.As an “academy city”, the <strong>City</strong> <strong>of</strong> <strong>Norman</strong> has the authority to retain $2 <strong>of</strong> the $9 penaltyassessment collected for police, court and prosecution training. All remaining funds collected areforwarded to CLEET. The <strong>City</strong> is authorized to keep a 2% administrative fee on the amountcollected, which is deducted from the $2 portion retained by the <strong>City</strong>.State law also requires that municipalities collect a Fingerprinting Fee in the amount <strong>of</strong> $5,which is to be collected and reported to the Oklahoma State Bureau <strong>of</strong> Investigation (OSBI). Themoneys collected from the fingerprinting fee pays for the Automated Fingerprint IdentificationSystem (AFIS) managed by the OSBI. An administrative fee <strong>of</strong> $.08 on each $5.00 assessment isretained by the <strong>City</strong>.State law also provides for the collection <strong>of</strong> the Forensic Science Improvement Assessmentin the amount <strong>of</strong> $5, which is to be collected at the same time and in the same manner as set forth inparagraph two above. Moneys from this fee are for the OSBI and will be used to upgradelaboratory facilities, equipment and personnel. Municipal courts are authorized to retain 5% <strong>of</strong> theamount collected as an administrative fee.In May 2008, a state law became effective which provides for a fee assessment <strong>of</strong> $5 onmarijuana convictions followed in July 2009 by a state law providing for the same assessment onparaphernalia convictions, to be collected and reported to the Bureau <strong>of</strong> Narcotics Drug EducationRevolving Fund. These fees are to be collected at the same time and in the same manner as set forthin paragraph two above. Monies from these fees are to be used for purposes relating to drugeducation and information in the State <strong>of</strong> Oklahoma. No administrative fee is provided.In summary, a total <strong>of</strong> $19 is collected on each traffic and non-traffic conviction or forfeiture(except possession <strong>of</strong> marijuana or paraphernalia which are $24), and deposited into a specialrevenue account created for that purpose. The assessments are in addition to and not in substitutionfor any and all fines and penalties otherwise provided for by law. The money retained by the <strong>City</strong>,as a result <strong>of</strong> being an academy city, is divided between administrative fees, police training, andcourt/prosecution training. The <strong>City</strong> is authorized to retain all interest accrued prior to the due datefor deposits. The remainder <strong>of</strong> money collected is forwarded monthly by the Court Clerk to CLEET,OSBI, and the Bureau <strong>of</strong> Narcotics.ANNUAL BUDGET73
