CÓDIGO TRIBUTARIO PROVINCIAL Ley Nº 5.121 1 (B.O. del 29/12/99) LIBRO PRIMERO PARTE GENERAL TÍTULO I DISPOSICIONES PRELIMINARES CAPÍTULO I NORMAS TRIBUTARIAS Aplicación Artículo 1º— Las disposiciones de este Código son aplicables a todos los tributos provinciales y a las relaciones jurídicas emergentes de ellos. Materia primitiva de la ley Artículo 3º— Sólo la ley puede: 1) Crear, modificar o suprimir tributos, definir el hecho imponible, fijar la alícuota del tributo y la base de su cálculo e indicar el sujeto pasivo, 2) Otorgar exenciones, reducciones o beneficios, 3) Tipificar las infracciones y establecer las respectivas sanciones, 4) Establecer privilegios, preferencias y garantías para los créditos tributarios. Interpretación Artículo 4º— Las normas tributarias se interpretarán con arreglo a todos los métodos admitidos en Derecho. Integración analógica Artículo 5º— La analogía es procedimiento admisible para colmar los vacíos legales, pero en virtud de ella no pueden crearse tributos ni exenciones. Principios aplicables Artículo 6º— En las situaciones que no pueden resolverse por las disposiciones de este Código o de las leyes específicas sobre cada materia, se aplicarán supletoriamente los principios generales de derecho tributario y en su defecto los de otras ramas jurídicas que más se avengan a su naturaleza y fines. Interpretación del hecho imponible Artículo 7º— Los actos, hechos o circunstancias sujetas a tributación, se considerarán conforme a su significación económica financiera en función social prescindiendo de su apariencia formal aunque esta corresponda a figuras o instituciones regladas por otras ramas del derecho.
