222 • <strong>Truth</strong> & Reconciliation CommissionCommission believes that <strong>the</strong> recent introduction of mandatory minimum sentencesand restrictions on conditional sentences will increase Aboriginal overrepresentationin prison. Such developments are preventing judges from implementing communitysanctions even when <strong>the</strong>y are consistent with <strong>the</strong> safety of <strong>the</strong> community and evenwhen <strong>the</strong>y have a much greater potential than imprisonment to respond to <strong>the</strong> intergenerationallegacy of residential schools that often results in offences by Aboriginalpersons. 141Call to Action32) We call upon <strong>the</strong> federal government to amend <strong>the</strong> Criminal Code to allow trialjudges, upon giving reasons, to depart from mandatory minimum sentences andrestrictions on <strong>the</strong> use of conditional sentences.Offenders with fasdThere is ano<strong>the</strong>r link between <strong>the</strong> substance abuse that has plagued many residentialschool Survivors and <strong>the</strong> over-incarceration of Aboriginal people. Fetal alcoholspectrum disorder (fasd) is a permanent brain injury caused when a woman’sconsumption of alcohol during pregnancy affects her fetus. The disabilities associatedwith fasd include memory impairments, problems with judgment and abstractreasoning, and poor adaptive functioning. 142 It is a debilitating cognitive impairment,which children must live with <strong>for</strong> <strong>the</strong> rest of <strong>the</strong>ir lives, through no fault of <strong>the</strong>ir own.A study done <strong>for</strong> <strong>the</strong> Aboriginal Healing Foundation drew links among <strong>the</strong> intergenerationaltrauma of residential schools, alcohol addictions, and fasd. 143 The studyconcluded that <strong>the</strong> “residential school system contributed to <strong>the</strong> central risk factorinvolved, substance abuse, but also to factors shown to be linked to alcohol abuse,such as child and adult physical, emotional and sexual abuse, mental health problemsand family dysfunction.” 144About 1% of Canadian children are born with some <strong>for</strong>m of disability related to prenatalalcohol consumption, but estimates from Canada and <strong>the</strong> United States suggestthat 15% to 20% of prisoners have fasd. 145 A recent Canadian study found that offenderswith fasd had much higher rates of criminal involvement than those without fasd,including more juvenile and adult convictions. 146 The Commission believes <strong>the</strong>re is aneed to take urgent measures both to prevent fasd and to better manage its harmfulconsequences. There is a clear need in Aboriginal communities <strong>for</strong> more programmingthat addresses <strong>the</strong> problems of addiction and fasd.
