hazards and necessary precautions<br />

➤ An understanding of safe systems of work, in particular,<br />

permits <strong>to</strong> work<br />

➤ How emergencies arise, the need <strong>to</strong> follow prepared<br />

emergency arrangements and the dangers of not<br />

doing so.<br />

15.13.5 Emergency arrangements – regulation 5<br />

This regulation requires that entry <strong>to</strong> a confi ned space<br />

<strong>to</strong> carry out work is prevented unless suitable and suffi<br />

cient arrangements have been prepared for the rescue<br />

of persons in the event of an emergency.<br />

These arrangements must:<br />

➤ Reduce, so far as is reasonably practicable, the<br />

risks <strong>to</strong> the health and safety of any person required<br />

<strong>to</strong> put the arrangements in<strong>to</strong> operation and<br />

➤ Include the provision and maintenance of necessary<br />

equipment for resuscitation procedures <strong>to</strong> be carried<br />

out<br />

➤ It is not reasonably practicable <strong>to</strong> achieve that purpose<br />

without such entry.<br />

The rescue arrangements should include consideration<br />

of the fac<strong>to</strong>rs detailed below:<br />

Fac<strong>to</strong>rs <strong>to</strong> be considered in the emergency arrangements<br />

Rescue and resuscitation equipment Control of plant<br />

Raising the alarm and rescue First aid<br />

Safeguarding the rescuers Public emergency<br />

services<br />

15.14 The Construction (Design and<br />

<strong>Management</strong>) Regulations 2007<br />

(SI 320)<br />

The Construction (Design and <strong>Management</strong>) Regulations<br />

2007 (CDM) are aimed at the design and management<br />

aspects of a construction project <strong>to</strong>gether with securing<br />

the safety of those undertaking or affected by construction<br />

operations. The regulations impose duties on the<br />

‘key players’ involved:<br />

➤ The client: any person for whom a project is<br />

carried out<br />

➤ The designer: any person who prepares a design<br />

➤ Coordina<strong>to</strong>r: a competent person appointed by<br />

the Client<br />

➤ Principal contrac<strong>to</strong>r: a competent person<br />

appointed by the Client<br />

➤ Other contrac<strong>to</strong>rs: all other contrac<strong>to</strong>rs involved<br />

with construction work.<br />

There is nothing <strong>to</strong> s<strong>to</strong>p the same person fi lling all of the<br />

key roles as long as they are competent and adequately<br />

resourced <strong>to</strong> do so. For example, clients could carry out<br />

their own design work, appoint themselves as coordina<strong>to</strong>r<br />

and principal contrac<strong>to</strong>r and carry out the work<br />

themselves.<br />

The regulations are broken down in<strong>to</strong> three parts<br />

with an additional fi ve Schedules the last of which are<br />

revocations, etc. from previous legislation.<br />

15.14.1 Part 1 – <strong>Introduction</strong> which includes the<br />

application<br />

CDM application:<br />

➤ Applies <strong>to</strong> all construction work<br />

➤ Notifi able projects <strong>to</strong> (HSE) involving more than 30<br />

days work on site or more than 500 person days<br />

have a greater level of control due <strong>to</strong> the complexity<br />

and risks involved.<br />

15.14.2 Part 2 – Duties<br />

The legislation clearly states that only competent persons<br />

can work or be involved with work under the CDM<br />

Regulations, with the exception of those being subject<br />

<strong>to</strong> competent supervision.<br />

Under the regulations there is the duty for all<br />

involved with the work <strong>to</strong> cooperate with all other parties<br />

and provide information regarding health and safety <strong>to</strong><br />

other parties involved.<br />

Client duties<br />

The client is responsible for:<br />

➤ Making arrangements <strong>to</strong> ensure that adequate<br />

resources are available <strong>to</strong> ensure health and safety<br />

is implemented and maintained during the project<br />

➤ Ensuring that reviews and revisions of all health and<br />

safety arrangements are undertaken throughout the<br />

project<br />

➤ Appointing a competent and adequately resourced<br />

coordina<strong>to</strong>r (Notifi able projects)<br />

➤ Appointing a competent and adequately resourced<br />

principal contrac<strong>to</strong>r (Notifi able projects)<br />

➤ Acting as the coordina<strong>to</strong>r and principal contrac<strong>to</strong>r<br />

until such time as each has been appointed<br />

➤ Providing relevant health and safety information<br />

about existing structures and/or the site which is <strong>to</strong><br />

be developed <strong>to</strong> the coordina<strong>to</strong>r for inclusion in the<br />

pre-tender health and safety plan
