If the duty lasts more than five hours per day or four hours per night, relief will be provided<br />

and double rates charged.<br />

(3) All sums recovered under this Rule shall be credited to the head XXIII - police collection<br />

of payments for services rendered, receipt on account of additional police under<br />

sections 13, 14 and 15 of <strong>Police</strong> Act 5 of 1861 and at the end of the month, recovery shall<br />

be made from the treasury on special additional police pay bills for disbursement to the<br />

actual police officers, in accordance with the principles laid down in Inspector-General’s<br />

letter No. 106-S/95-4-B-27-A, dated the 31st May, 1928, namely that remuneration shall<br />

only be given when the extra duties performed involve less than 24 hours’ absence from<br />

normal duty. Thus if a constable is deputed to attend a private function, such as a wedding,<br />

which involves his absence from normal duty throughout the whole of one working<br />

day, say from sunrise to midnight, he will be considered as having performed over-time<br />

duty and will be entitled to extra remuneration, but should the duty involve his absence<br />

from sunrise to sunset of the following day, he will not be considered as on over-time duty<br />

and will be entitled to no remuneration in addition to his pay. Superintendents may, however,<br />

use their discretion in dealing with cases in which, in their opinion, the 24-hour rule<br />

cannot in fairness be applied.<br />

(4) In deciding when to supply police at the public expense, and when to charge the promoters<br />

of a particular function, Superintendents shall be guided by the general principle<br />

that the regular police establishment is required to perform all the duties of maintaining<br />

public order, which fall within scope of section 31 of the <strong>Police</strong> Act. When special arrangements<br />

are necessary or desired over and above those which the general public<br />

interests demand, the person or persons responsible for the assembly concerned should<br />

pay for additional police. The law does not permit of compulsion being exercised in this<br />

matter, but Superintendents may tender their advice and indicate that no more police than<br />

are necessary to prevent obstruction to the general public will be provided unless paid for.<br />

Note:- Government has ordered that "if any sect requires, in religious processions organized by<br />

them, the assistance of the police to maintain order, to such an extent as to necessitate extra<br />

expenditure by bringing a larger police force together, or otherwise, the cost should invariably<br />

be charged to the persons requiring the extra police protection and the same should be<br />

paid before the procession is allowed to take place" (Home Department No. 1073 of 14th<br />

March, 1878). This order does not mean that charges shall be levied for the supply of police<br />

to processions of ancient and regularly exercised custom in cases where the supply is not in<br />

excess of that given for a series of years, and the practice has been to give such supply for<br />

a long period without charge.<br />

Rule 2.14<br />

2.14. Supply of police under section 14. - Cases coming within the scope of section<br />

14 of the <strong>Police</strong> Act, 1861, must be referred through (1) District Magistrate, (2) Deputy<br />

Inspector-General of <strong>Police</strong>, and (3) Commissioner, to the Inspector-General of <strong>Police</strong> for<br />

orders.<br />

Rule 2.15<br />

2.15. Supply of police free of charge in emergencies. - Superintendents may at their<br />

discretion supply additional police to departments and officers of Government from the<br />

regular police establishment in cases of emergency and for duties of a strictly temporary<br />

and non-recurrent nature without charge.<br />

Rule 2.16<br />

2.16. Entertainment of and charges for extra establishments. - If the police are required<br />

for any lengthy period, application shall be made to the Inspector-General for the
