82 <strong>Punjab</strong> <strong>Police</strong> <strong>Rules</strong>, 1934 <strong>Volume</strong> 1, CHAPTER 4<br />
Witness, that in consideration of the stipulation hereinafter contained and by the said<br />
Governor of the <strong>Punjab</strong> and the said A.B., respectively, to be observed and performed, the<br />
said A.B., hereby undertakes to make up and deliver (specification, number and description<br />
of articles)<br />
2. That all the said articles shall be made equal in quality and similar in colour and size<br />
to a sealed muster pattern now deposited with __________ at __________ and shall be<br />
made and finished in a workman-like manner to the satisfaction of the Superintendent of<br />
<strong>Police</strong> of __________ .<br />
3. That of the whole number of articles agreed to be made up and delivered __________<br />
will be delivered within __________ days and the remainder within __________ days<br />
of the date of this agreement.<br />
4. That all deliveries shall be made at the office of the said Superintendent of <strong>Police</strong> at<br />
__________ between the hours of 10 p.m. and 4 p.m. on working days only.<br />
5. That every article shall be made finished in all respects to the entire satisfaction of<br />
the said Superintendent of <strong>Police</strong> and he shall be at liberty to reject any article if he does<br />
not approve, and such rejection shall be final and conclusive.<br />
6. That the said Superintendent of <strong>Police</strong> shall give a written receipt, signed by him,<br />
within __________ days of delivery exhibiting the number of articles and the numbers accepted<br />
and rejected, and such receipts shall be conclusive evidence of the acceptance and<br />
rejection of the number of articles specified as accepted and rejected.<br />
7. That all articles thus rejected shall be taken back and removed by the said A.B. and<br />
nothing shall become due to or recoverable by said A.B. in respect of any article so rejected.<br />
8. That all articles thus accepted shall be paid for by the said Superintendent of <strong>Police</strong><br />
at the rate of Rs. __________ for each article, within six days after and exclusive of the<br />
date of such acceptance.<br />
9. And it is hereby lastly agreed that, if, and so often as the said A.B. shall make default<br />
in the due performance of any one or more of the stipulations hereinbefore contained by<br />
him to be performed and observed, then, and in any such case, the said Superintendent of<br />
<strong>Police</strong> shall be at liberty to assess the amount, not exceeding Rs. __________ that shall<br />
represent the damages arising from any such default on the part of the said A.B. and the<br />
assessment of the said Superintendent of <strong>Police</strong> shall be final and conclusive as to the<br />
amount of such damages. Such amount shall thereupon become payable by the said A.B.<br />
to the said Superintendent of <strong>Police</strong>. And the said Superintendent of <strong>Police</strong> shall be at liberty<br />
to deduct and retain any amount so assessed from any sum of money that may be or<br />
may become due and payable at or after the time of such failure, to the said A.B. by the<br />
said Superintendent of <strong>Police</strong>, whether by virtue of this agreement or otherwise.<br />
10. And in order to assist the said A.B. towards the due performance of his undertaking<br />
it is hereby further agreed that the said Superintendent of <strong>Police</strong> shall advance to the said<br />
A.B. such sum of money, not exceeding Rs. __________ , at any one time as the said A.B.<br />
shall from time to time in writing require as advances to be applied by the said A.B. to the<br />
purposes of this contract, and not otherwise.<br />
11. Provided that the said Superintendent of <strong>Police</strong> shall not be required, nor be bound<br />
to make any such advance unless and until the said A.B. shall have given security approved<br />
by the said Superintendent of <strong>Police</strong> to the amount of Rs. __________ , for the due<br />
performance of his contract and the proper application of such advances.<br />
12. Provided also that the said Superintendent of <strong>Police</strong> shall not be required, nor be<br />
bound, to make a second or further advance, unless and until it shall have been shown to<br />
his satisfaction by the said A.B. that every previous advance has been properly applied by<br />
the said A.B. for the purpose of his contract, and not otherwise.
