RESOLUTION AUTHORIZING A TEMPORAY LICENSE AGREEMENT WITH GZA
GEOENVIRONMNTAL, INC., FOR THE PUROSE OF INSTALLING TEST
BORINGS ON WATER AQUEDUCT PROPERTY IN FAIRFIELD, NEW JERSEY,
AS PART OF A STATE-MAATED INVSTIGATION FOR PCBs IN THE ARA
WHEREAS, the City has a right-of-way in Block 2302, Lot 8, in
Fairfield, New Jersey (hereinafter referred to as the "Property") for
its water aqueduct and all appurtenances thereto and
WHEREAS, GZA GeoEnvironmental, Inc., 65 Willowbrook Blvd., Wayne,
New Jersey 07470 (hereinafter referred to as Licensee) has requested
permission to enter upon certain lands 'and premïses over which the
Licensor has a right-of-way for its water aqueduct and appurtenances
thereto situated in. Block 2302, Lot 8, On the tax map of Fairfield, New
Jersey, for the purpose of installing test borings as part of a statemandated
investigation for PCBs in the area (the project is more fully
described in the plans submitted to and approved by the Jersey Ci ty
Water Engineer); and
WHEREAS, GZA shall pay to the City the sum of three thousand
dollars ($3, 000.00) to reimburse the Licensor for all costs and expenses
associated with this agreement; and
WHEREAS, GZA will procure and maintain a minimum of one million
dollars of general liability insurance covering the project with the
City named as an additional insured; and
WHEREAS, GZA will share any and all results obtained from the test
borings with the City; and
WHEREAS, it is considered to be in the best interests of the City
to ascertain any and all information concerning PCBs in the area of its
wa ter aqueduct.
THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Jersey
City that:
1. A Temporary License Agreement, in a form substantially similar
to that annexed hereto and approved by the Corporation
Counsel, be granted to GZA GeoEnvironmental, Inc., for the
purpose of installing test borings on certain of the City's
