II. TIME AND PLACE OF WORK<br />

The Physician will be present as needed, and shall work hours agreed upon by <strong>the</strong> Physician and <strong>the</strong><br />

Coordina<strong>to</strong>r of <strong>the</strong> Child Health Care Clinic of <strong>Jersey</strong> <strong>City</strong>, provided <strong>the</strong> Physician shall be <strong>available</strong>,<br />

as necessary, for <strong>the</strong> entire period of a scheduled immunization session.<br />

The Physician also will provide <strong>the</strong> foregoing service for immunization clinics, health related,<br />

outreach programs for infants, pre-school children, adults and Child Health Conference sessions<br />

suitabilityJor immunization of individuals and shall provide immunizations at community outreach<br />

programs.<br />

III. COMPENSATION<br />

For all services rendered, under <strong>the</strong> terms of this agreement, <strong>the</strong> Physician is <strong>to</strong> be paid: $55.00 per<br />

hour. The Physician shall bil <strong>the</strong> <strong>City</strong> for services rendered during <strong>the</strong> month, provided all elements<br />

of <strong>the</strong> Agreement are satisfac<strong>to</strong>rily met. The Physician will not bill <strong>the</strong> patient or health insurance<br />

programs,<br />

iv. RELATIONSHIP OF PARTIES<br />

The parties agree that <strong>the</strong> Physician and <strong>the</strong> relation created by this contract is that of employer and<br />

independent contrac<strong>to</strong>r. The Physician is not an employee of <strong>the</strong> <strong>City</strong>, is nQt entitled <strong>to</strong> <strong>the</strong> benefits<br />

provided by <strong>the</strong> employer <strong>to</strong> its employees, including but not limited <strong>to</strong> group insurance, pension<br />

plan and workmen and compensation benefits. Physician may practice his/her service for o<strong>the</strong>rs<br />

during those periods when <strong>the</strong> physician is not performing work under <strong>the</strong> contract for <strong>the</strong> <strong>City</strong>.<br />

V. LIABILITY AND INSURANCE<br />

The services <strong>to</strong> be rendered under this contract will be rendered entirely at <strong>the</strong> physician's risk. The<br />

Physician shall purchase and maintain at his/her expense such comprehensive professional (Medical<br />

Malpractice insurance for not less than $1,000,000) or o<strong>the</strong>r liability insurance coverage. The<br />

Physician also agrees <strong>to</strong> defend, hold <strong>the</strong> <strong>City</strong> harmless and indemnify <strong>City</strong> for any lia~ilitl_9r loss<br />

arising in any way out of <strong>the</strong> performance of <strong>the</strong> contract.<br />

VI. FACILITIES<br />

The <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> shall operate and maintain facilities and provide at its own cost supplies and<br />

equipment necessary and proper <strong>to</strong> <strong>the</strong> performance of <strong>the</strong> Physician's position.<br />
