RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREE ME 0-l~ S~~<br />

WITH JOHN CURLEY, ESQ. TO REPRESENT THE CITY IN CONDEMNATION ORA11<br />

MATTERS RELATING TO THE ACQUISITION OF PROPERTIES IN CONNECTION<br />

WITH THE RELOCATION OF THE JERSEY CITY DEPARTMENT OF PUBLIC WORKS<br />

AND THE JERSEY CITY INCINERATOR AUTHORITY<br />

COUNCIL offered and moved adoption of <strong>the</strong> following resolution:<br />

WHEREAS, <strong>the</strong> Corporation Counsel has deterllined that it is necessary <strong>to</strong> engage outside<br />

counsel <strong>to</strong> represent and advise <strong>the</strong> <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> in <strong>the</strong> acquisition of property located at<br />

13-15 and 20 East Linden A venue for <strong>the</strong> relocation of <strong>the</strong> <strong>Jersey</strong> <strong>City</strong> Department of Public<br />

Works and <strong>the</strong> <strong>Jersey</strong> <strong>City</strong> Inciera<strong>to</strong>r Authority; and<br />

WHEREAS, such services qualify as professional services exempt from public bidding under<br />

<strong>the</strong> Local Public Contracts Law, N.J.5.A. 40A:ll-1 et seq; and<br />

WHEREAS, John Curley, Esq. is an at<strong>to</strong>rney qualified <strong>to</strong> perform <strong>the</strong>se services; and<br />

WHEREAS, special counsel agrees <strong>to</strong> provide <strong>the</strong>se services at an hourly rate of $175.00 per<br />

hour, including expenses, for a <strong>to</strong>tal amount not <strong>to</strong> exceed $75,000; and<br />

WHEREAS, <strong>the</strong> <strong>City</strong> is acquiring <strong>the</strong>se services directly and openly as a statu<strong>to</strong>rily permitted<br />

contract pursuant <strong>to</strong> <strong>the</strong> provisions of N.r.S.A. 19:44A-20.4 et seq. (<strong>the</strong> Pay-<strong>to</strong>-Play Law); and<br />

WHEREAS, John J. Curley, Esq. has completed and submitted a Business Entity Disclosure<br />

Certification which certifies that he has not made any reportable contributions <strong>to</strong> <strong>the</strong> political<br />

or candidate committees listed in <strong>the</strong> Business Entity Disclosure Certification in <strong>the</strong> previous<br />

one year, and that <strong>the</strong> contract wil prohibit Mr. Curley from making any reportable<br />

contributions during <strong>the</strong> term of <strong>the</strong> contract; and<br />

WHEREAS, John J. Curley, Esq. has submitted a Chapter 271 Political Contribution Disclosure<br />

Certification at least 10 days prior <strong>to</strong> <strong>the</strong> award of this contract; and<br />

WHEREAS, John J. Curley, Esq. has submitted its Certification of Compliance with <strong>the</strong> <strong>City</strong>'s<br />

Contrac<strong>to</strong>r Pay-<strong>to</strong>-Play Reform Ordinance 08-128 adopted on September 3, 2008; and<br />

WHEREAS, $1,000 of <strong>the</strong>se fuds are <strong>available</strong> for <strong>the</strong> costs of <strong>the</strong>se services in <strong>the</strong> Honeywell<br />

Relocation Account No.: 04-226-55-000-029; and<br />

WHEREAS, <strong>the</strong> balance of fuds wil be made <strong>available</strong> for <strong>the</strong> costs of <strong>the</strong>se services in <strong>the</strong><br />

Honeywell Relocation Account Nq, 04-226-55-000-029.<br />

NOW, THEREFORE, BE IT RESOLVED, by <strong>the</strong> Muncipal Council of <strong>the</strong> <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong><br />

that:<br />

1. An agreement is awarded <strong>to</strong> JohnJ. Curley, Esq. <strong>to</strong> represent and advise <strong>the</strong> <strong>City</strong> of<br />

<strong>Jersey</strong> <strong>City</strong> in connection with <strong>the</strong> acquisition of property located at 13-15 and 20 East Linden
