RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES AGREE ME 0-l~ S~~
WITH JOHN CURLEY, ESQ. TO REPRESENT THE CITY IN CONDEMNATION ORA11
MATTERS RELATING TO THE ACQUISITION OF PROPERTIES IN CONNECTION
WITH THE RELOCATION OF THE JERSEY CITY DEPARTMENT OF PUBLIC WORKS
AND THE JERSEY CITY INCINERATOR AUTHORITY
COUNCIL offered and moved adoption of the following resolution:
WHEREAS, the Corporation Counsel has deterllined that it is necessary to engage outside
counsel to represent and advise the City of Jersey City in the acquisition of property located at
13-15 and 20 East Linden A venue for the relocation of the Jersey City Department of Public
Works and the Jersey City Incierator Authority; and
WHEREAS, such services qualify as professional services exempt from public bidding under
the Local Public Contracts Law, N.J.5.A. 40A:ll-1 et seq; and
WHEREAS, John Curley, Esq. is an attorney qualified to perform these services; and
WHEREAS, special counsel agrees to provide these services at an hourly rate of $175.00 per
hour, including expenses, for a total amount not to exceed $75,000; and
WHEREAS, the City is acquiring these services directly and openly as a statutorily permitted
contract pursuant to the provisions of N.r.S.A. 19:44A-20.4 et seq. (the Pay-to-Play Law); and
WHEREAS, John J. Curley, Esq. has completed and submitted a Business Entity Disclosure
Certification which certifies that he has not made any reportable contributions to the political
or candidate committees listed in the Business Entity Disclosure Certification in the previous
one year, and that the contract wil prohibit Mr. Curley from making any reportable
contributions during the term of the contract; and
WHEREAS, John J. Curley, Esq. has submitted a Chapter 271 Political Contribution Disclosure
Certification at least 10 days prior to the award of this contract; and
WHEREAS, John J. Curley, Esq. has submitted its Certification of Compliance with the City's
Contractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3, 2008; and
WHEREAS, $1,000 of these fuds are available for the costs of these services in the Honeywell
Relocation Account No.: 04-226-55-000-029; and
WHEREAS, the balance of fuds wil be made available for the costs of these services in the
Honeywell Relocation Account Nq, 04-226-55-000-029.
NOW, THEREFORE, BE IT RESOLVED, by the Muncipal Council of the City of Jersey City
that:
1. An agreement is awarded to JohnJ. Curley, Esq. to represent and advise the City of
Jersey City in connection with the acquisition of property located at 13-15 and 20 East Linden
