of plans and specifications therefor. Such heavy equipment
shall include but shall not be limited to the Nodwell 110
multi-purpose two-tracked vehicle.
10. The Licensee shall assume all costs and expenses
in connection with the construction operation, maintenance,
and repair of the said construction.
11. The Licensee agrees not to knowingly undertake any
act which would impair the structural integrity or the
operation of the Jersey City water supply aqueducts, which
run through the subj ect property. The Licensee agrees to
indemnify, defend, and hold harmless the Licensor from any
damages it may suffer and from any liabilities, claims,
demand, suits, or judgments brought or rendered against it
as a result of any acts or omissions of the Licensee, or its
agents, which impair the structural integrity or operation
of the Jersey City water supply aqueducts.
12. Licensee agrees to provide 'the Jersey City Water
Engineer with AS-BUILT drawings of any construction taking
place under this Agreement 'upon completion of such
construction.
13. Licensee agrees to provide Licensor with a copy of
any and all reports containing the results of all testing
done on the premises which are subj ect of this agreement.
