RESOLUTION AUTHORIZING THE CITY OF JERSEY CITY TO EXECUTE A LICENSE<br />

AGREEMENT WITH THE JERSEY CITY EPISCOPAL COMMUNITY DEVELOPMENT<br />

CORPORATION<br />

offered and moved adoption of <strong>the</strong> following<br />

WHEREAS, <strong>the</strong> <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> is <strong>the</strong> owner of property located in Block 1986; Lot 3, more<br />

commonly known as 242 Bergen Avenue;and<br />

WHEREAS, <strong>the</strong> J.C. Episcopal CDC a non-profit corporation of <strong>the</strong> State of New <strong>Jersey</strong>, needs<br />

<strong>to</strong> enter on <strong>the</strong> <strong>City</strong>'s property <strong>to</strong> evaluate <strong>the</strong> feasibility of developing affordable housing on<br />

said property; and<br />

WHEREAS, <strong>the</strong> J.C. Episcopal CDC will fully defend and insure <strong>the</strong> <strong>City</strong> for any damages or<br />

injuries arising from its use of property; and<br />

WHEREAS, it is in <strong>the</strong> best interest of <strong>the</strong> <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> <strong>to</strong> grant <strong>the</strong> J.C. Episcopal CDC<br />

access <strong>to</strong> <strong>the</strong> property, subject <strong>to</strong> <strong>the</strong> terms and conditions set forth in <strong>the</strong> License Agreement<br />

attached.<br />

NOW, THEREFORE, BE IT RESOLVED by <strong>the</strong> Municipal Council of <strong>the</strong> <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> that<br />

<strong>the</strong> Mayor or Business Administra<strong>to</strong>r is hereby authorized <strong>to</strong>;<br />

1. Enterin<strong>to</strong> a License Agreement granting permission <strong>to</strong> J.C.Episcopal CDC <strong>to</strong> enter on<strong>to</strong><br />

Block 1986, Lot 3, more commonly known as 242 Bergen Avenue for a period not <strong>to</strong> exceed<br />

180 days commencing on <strong>the</strong> date <strong>the</strong> agreement is signed.<br />

2. The License Agreement shall be in substantially <strong>the</strong> form attached, subject <strong>to</strong> such<br />

modifications or additional terms and conditions as <strong>the</strong> Business Administra<strong>to</strong>r and<br />

Corporation Counsel deem necessary and appropriate.<br />

3. Take such o<strong>the</strong>r actions as may be necessary <strong>to</strong> effectuate <strong>the</strong> purposes of <strong>the</strong> agreement.<br />
