Department formulated a Chambo Restoration Strategic Plan, <strong>in</strong> which it is stated that a<br />

review <strong>of</strong> policies is needed to:<br />

1. establish the legal status <strong>of</strong> BVCs, enabl<strong>in</strong>g them to enforce the law <strong>in</strong> co-management<br />

with DoF, and <strong>in</strong>stitutionalise the adm<strong>in</strong>istrative structure <strong>of</strong> District Assemblies and<br />

local authorities (i.e., Area Management Committees);<br />

2. under the Lands Act, assign exclusive fish<strong>in</strong>g zones to BVCs and Area Management<br />

Committees, as well as the right to limit entry <strong>of</strong> additional fishers;<br />

3. establish protected areas and sanctuaries, and confer upon communities the right to<br />

protect areas <strong>in</strong> l<strong>in</strong>e with approved Area Management Plans;<br />

4. encourage private sector and foreign <strong>in</strong>vestment <strong>in</strong> aquaculture, and provide fiscal<br />

<strong>in</strong>centives to <strong>in</strong>vestors for research to pioneer new production systems for chambo; and<br />

5. establish a code <strong>of</strong> conduct <strong>in</strong> l<strong>in</strong>e with FAO Regulations for Responsible Aquaculture, to<br />

regulate the fisheries and aquaculture sector <strong>in</strong> Malawi, especially to control <strong>in</strong>troductions<br />

and convey rights for cage farm<strong>in</strong>g.<br />

While the suggested policy reviews <strong>in</strong> (1) and (2) above aim at empower<strong>in</strong>g BVCs and<br />

<strong>in</strong>creas<strong>in</strong>g ownership <strong>of</strong> the resources to limit additional fishers, they fall short <strong>of</strong> address<strong>in</strong>g<br />

the causes <strong>of</strong> the fishery decl<strong>in</strong>e. For example, clarify<strong>in</strong>g the legal status <strong>of</strong> BVCs may not<br />

assist <strong>in</strong> enforc<strong>in</strong>g the law. This enforcement role <strong>of</strong> BVCs would entail provid<strong>in</strong>g resources<br />

for BVCs, a step that was perhaps not the <strong>in</strong>tention <strong>of</strong> co-management. Similarly, provid<strong>in</strong>g<br />

exclusive zones as a way to limit<strong>in</strong>g entry <strong>in</strong>to may not be a solution where people do not<br />

abide by the law. Instead, the follow<strong>in</strong>g steps are suggested:<br />

5.1 Increase ownership <strong>of</strong> BVC and the PFM program<br />

This and previous studies have shown that BVCs are exogenous to the system. <strong>The</strong>y appear<br />

to be imposed, and power struggles do exist. Empower<strong>in</strong>g these <strong>in</strong>stitutions, therefore, may<br />

not help. Careful study is needed to understand power relations and to determ<strong>in</strong>e how BVCs<br />

or similar <strong>in</strong>stitutions can become owned by the communities. <strong>The</strong> f<strong>in</strong>d<strong>in</strong>gs <strong>of</strong> this study can<br />

be <strong>in</strong>corporated <strong>in</strong>to a policy review. <strong>The</strong> communities must see the need for the <strong>in</strong>tervention.<br />

All efforts to bestow user rights upon the BVCs are bound to fail if such a perception is not<br />

achieved.<br />

5.2 Provide targeted <strong>in</strong>come-generat<strong>in</strong>g activities<br />

<strong>The</strong>re will be no headway <strong>in</strong> solv<strong>in</strong>g the problem <strong>of</strong> <strong>in</strong>creas<strong>in</strong>g entry <strong>in</strong>to the fishery if<br />

poverty issues are not tackled. Past efforts to provide <strong>in</strong>come-generat<strong>in</strong>g activities to gear<br />

owners proved futile because the target was wrong. <strong>The</strong>re is hardly a substitute activity that<br />

could provide as much <strong>in</strong>come to gear owners as fish<strong>in</strong>g. Target<strong>in</strong>g crew members, however,<br />

may reduce entry <strong>in</strong>to the fishery. One typical case noted dur<strong>in</strong>g the study was a chilimira<br />

owner who had hung up his fish<strong>in</strong>g gear because his crew members got jobs with a road<br />

construction company <strong>in</strong> the area.<br />

In some cases, licenses are used to limit entry <strong>in</strong>to the fishery. Where enforcement is limited,<br />

however, licenses do not work. For example, people on Lake Malawi, though not allowed to<br />

use nkacha, used their relations from Lake Malombe to get licenses and operated nkacha on<br />

Lake Malawi waters.
