threats to use force.<br />

The second fetvā/treatise declaring the faithlessness (küfr) of the qizilbashes was<br />

issued by Kemalpaşazāde. Indeed, there are at least two fetvās issued by Kemalpaşazāde,<br />

one in Arabic and the other in Turkish. His Turkish fetvā is in a classical question-<br />

answer form. Kemalpaşazāde answers the questions on whether it is authorized by the<br />

religion to kill the qizilbashes and to declare gazā against them; and whether those who<br />

were killed in this war are şehits. His answers are: “Yes it is a great gazā” and “yes, they<br />

are absolutely şehits.” 1807 The other fetvā/treatise of Kemalpaşazāde, which is written in<br />

Arabic, is not in the classical question-answer format. It is rather a memorandum<br />

proclaiming the heresy of the qizilbashes and the legitimization war against them. From<br />

this perspective, it would be rather appropriate to name this text as a ‘treatise’ (risāle)<br />

rather than a ‘fetvā’. 1808 There are several copies of this treatise. The one included in<br />

Mecmūa-i Resā’īl is published by Şehabeddin Tekindağ. 1809 Another copy is published<br />

by Elke Eberhard. 1810<br />

None of these copies are dated. Elke Eberhard predicts that the first fetvā of<br />

Kemalpaşazāde, the Arabic one, must have been written in between 1513-14, while his<br />

second fetvā must have been issued between 1525 and 1535. 1811 One should remember<br />
