50 That <strong>Clubs</strong><strong>NSW</strong> <strong>in</strong>troduce best practice recommendations <strong>in</strong>to its Best Practice<br />

Guidel<strong>in</strong>es, and revise its Code <strong>of</strong> Practice to require a club which does not follow a best<br />

practice recommendation to disclose its reasons <strong>in</strong> its annual report.<br />

9.3.6 Enhanc<strong>in</strong>g <strong>Clubs</strong><strong>NSW</strong>’s role <strong>in</strong> assist<strong>in</strong>g smaller clubs with <strong>the</strong>ir compliance<br />

obligations<br />

Several stakeholders commented on <strong>the</strong> difficulties faced by smaller clubs <strong>in</strong><br />

comply<strong>in</strong>g with <strong>the</strong> <strong>Registered</strong> <strong>Clubs</strong> Act. While larger clubs were able to afford<br />

compliance <strong>of</strong>ficers to manage <strong>the</strong>ir compliance obligations, this was not an option<br />

for smaller clubs due to <strong>the</strong> costs <strong>in</strong>volved.<br />

IPART notes that OLGR has provided useful compliance tools for clubs, <strong>in</strong>clud<strong>in</strong>g a<br />

self-audit checklist and a standards and systems audit. 175 However, <strong>the</strong>re is scope for<br />

fur<strong>the</strong>r assistance <strong>in</strong> this area for smaller clubs. It considers that <strong>Clubs</strong><strong>NSW</strong> should<br />

employ a pool <strong>of</strong> compliance <strong>of</strong>ficers for smaller clubs to use as needed, on terms<br />

similar to those set out below:<br />

A club requests <strong>Clubs</strong><strong>NSW</strong> to allocate a compliance <strong>of</strong>ficer to it for a fixed period<br />

<strong>of</strong> time.<br />

The compliance <strong>of</strong>ficer provides <strong>the</strong> club with services such as:<br />

– audit<strong>in</strong>g <strong>the</strong> club’s current level <strong>of</strong> compliance with <strong>the</strong> <strong>Registered</strong> <strong>Clubs</strong> Act<br />

requirements<br />

– review<strong>in</strong>g <strong>the</strong> systems <strong>the</strong> club has <strong>in</strong> place to manage compliance.<br />

<strong>Clubs</strong><strong>NSW</strong> charges <strong>the</strong> club for <strong>the</strong> compliance <strong>of</strong>ficer’s services on a cost<br />

recovery basis. That is, <strong>Clubs</strong><strong>NSW</strong> charges <strong>the</strong> club a fee equal to <strong>the</strong> cost<br />

<strong>in</strong>curred by <strong>Clubs</strong><strong>NSW</strong> for salary, <strong>in</strong>surance etc, to provide this compliance<br />

service per year, pro rata for <strong>the</strong> number <strong>of</strong> days <strong>the</strong> club uses <strong>the</strong> compliance<br />

<strong>of</strong>ficer over that year.<br />

The compliance <strong>of</strong>ficer is subject to confidentiality arrangements with <strong>the</strong> various<br />

clubs s/he assists.<br />

Only clubs with gam<strong>in</strong>g mach<strong>in</strong>e revenue <strong>of</strong> $1 million or less a year should be<br />

able to access <strong>the</strong> service.<br />
