A Terms <strong>of</strong> reference<br />

I, Morris Iemma, Premier <strong>of</strong> New South Wales, pursuant to Section 9 <strong>of</strong> <strong>the</strong><br />

Independent Pric<strong>in</strong>g and Regulatory Tribunal Act 1992, request <strong>the</strong> Tribunal’s assistance<br />

<strong>in</strong> review<strong>in</strong>g and mak<strong>in</strong>g recommendations on <strong>the</strong> role and performance <strong>of</strong> <strong>the</strong> <strong>NSW</strong><br />

<strong>Registered</strong> <strong>Clubs</strong> <strong>in</strong>dustry, with <strong>the</strong> purpose <strong>of</strong> facilitat<strong>in</strong>g a susta<strong>in</strong>able <strong>Registered</strong><br />

<strong>Clubs</strong> <strong>in</strong>dustry <strong>in</strong> <strong>the</strong> future.<br />

The <strong>NSW</strong> Government acknowledges <strong>the</strong> valuable social and economic contribution<br />

made by registered clubs to <strong>the</strong> State’s social <strong>in</strong>frastructure and services.<br />

Social, demographic and commercial changes over <strong>the</strong> past 10 years have affected <strong>the</strong><br />

<strong>Registered</strong> <strong>Clubs</strong> <strong>in</strong>dustry <strong>in</strong> many ways. Commitment to <strong>the</strong> overall <strong>in</strong>dustry<br />

appears strong. However <strong>the</strong> ability <strong>of</strong> <strong>in</strong>dividual clubs to provide services that meet<br />

<strong>the</strong> needs <strong>of</strong> members and <strong>the</strong> community while cont<strong>in</strong>u<strong>in</strong>g to be f<strong>in</strong>ancially viable,<br />

differs depend<strong>in</strong>g on location, size and many o<strong>the</strong>r factors.<br />

The <strong>NSW</strong> Government wishes to assist <strong>the</strong> clubs <strong>in</strong>dustry to flourish, while<br />

stipulat<strong>in</strong>g that <strong>the</strong> <strong>in</strong>dustry meets its mutuality requirements, works co-operatively<br />

with Government and o<strong>the</strong>r community members <strong>in</strong> provid<strong>in</strong>g substantial<br />

community support that is effectively targeted, and operates <strong>in</strong> a commercial and<br />

pr<strong>of</strong>essional manner.<br />

I would appreciate <strong>the</strong> Tribunal’s assistance <strong>in</strong> undertak<strong>in</strong>g a review and mak<strong>in</strong>g<br />

recommendations that will assist <strong>Registered</strong> <strong>Clubs</strong> to enhance <strong>the</strong>ir role <strong>in</strong> <strong>the</strong><br />

community <strong>in</strong> an efficient and effective manner. The outcome for <strong>the</strong> review will be<br />

a framework for a management plan that supports and guides a susta<strong>in</strong>able<br />

registered clubs <strong>in</strong>dustry for a 10 to 15 year period.<br />

In conduct<strong>in</strong>g <strong>the</strong> review, <strong>the</strong> Tribunal is asked to recognise <strong>the</strong> diversity <strong>of</strong> <strong>the</strong><br />

constituents <strong>of</strong> <strong>the</strong> <strong>Registered</strong> <strong>Clubs</strong> <strong>in</strong>dustry and <strong>the</strong> diversity <strong>in</strong> <strong>the</strong> needs and<br />

expectations <strong>of</strong> members <strong>of</strong> <strong>in</strong>dividual <strong>Registered</strong> <strong>Clubs</strong> and communities <strong>in</strong> which<br />

<strong>Registered</strong> <strong>Clubs</strong> operate. It is also to recognise <strong>the</strong> different needs <strong>of</strong> clubs <strong>in</strong><br />

metropolitan, regional and remote areas.<br />
