2 The registered clubs <strong>in</strong>dustry <strong>in</strong> <strong>NSW</strong><br />

2.3.2 Oversight bodies<br />

From 1 July 2008, four ma<strong>in</strong> bodies will oversee <strong>the</strong> clubs <strong>in</strong>dustry, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong>:<br />

<strong>NSW</strong> M<strong>in</strong>ister for Gam<strong>in</strong>g and Rac<strong>in</strong>g (<strong>the</strong> M<strong>in</strong>ister)<br />

<strong>NSW</strong> Office <strong>of</strong> Liquor, Gam<strong>in</strong>g and Rac<strong>in</strong>g (OLGR), with<strong>in</strong> <strong>the</strong> <strong>NSW</strong> Department<br />

<strong>of</strong> <strong>the</strong> Arts, Sport and Recreation (<strong>the</strong> Department)<br />

Director <strong>of</strong> Liquor and Gam<strong>in</strong>g established under <strong>the</strong> Liquor Act 2007<br />

<br />

Cas<strong>in</strong>o, Liquor and Gam<strong>in</strong>g Control Authority (CLGCA).<br />

The M<strong>in</strong>ister, <strong>the</strong> Department and <strong>the</strong> CLGCA are responsible for adm<strong>in</strong>ister<strong>in</strong>g <strong>the</strong><br />

specific legislation related to registered clubs. OLGR, located with<strong>in</strong> <strong>the</strong> Department,<br />

implements policy and education <strong>in</strong>itiatives for liquor, gam<strong>in</strong>g, charity and rac<strong>in</strong>g<br />

<strong>in</strong>dustries. It also conducts enforcement and compliance activities, and (along with<br />

<strong>the</strong> <strong>NSW</strong> Police Force) prosecutes crim<strong>in</strong>al <strong>of</strong>fences under <strong>the</strong> relevant legislation.<br />

The CLGCA, established under <strong>the</strong> Cas<strong>in</strong>o, Liquor and Gam<strong>in</strong>g Control Authority<br />

Act, has state-wide jurisdiction and deals with a multitude <strong>of</strong> applications under <strong>the</strong><br />

Liquor and <strong>Registered</strong> <strong>Clubs</strong> Acts. These <strong>in</strong>clude applications for <strong>the</strong> grant <strong>of</strong> new<br />

liquor and gam<strong>in</strong>g licences (<strong>in</strong>clud<strong>in</strong>g liquor licences for registered clubs), <strong>the</strong><br />

transfer <strong>of</strong> licences and club amalgamations, changes <strong>of</strong> a club secretary, <strong>the</strong> removal<br />

<strong>of</strong> licences to different premises and changes to licence conditions. The CLGCA also<br />

deals with discipl<strong>in</strong>ary proceed<strong>in</strong>gs aga<strong>in</strong>st licensees and clubs.<br />

Compla<strong>in</strong>ts about undue disturbance <strong>of</strong> <strong>the</strong> quiet and good order <strong>of</strong> <strong>the</strong><br />

neighbourhood <strong>of</strong> registered clubs, along with some matters affect<strong>in</strong>g <strong>the</strong> conditions<br />

and operation <strong>of</strong> club licences, are dealt with by <strong>the</strong> Director <strong>of</strong> Liquor and Gam<strong>in</strong>g<br />

under <strong>the</strong> Liquor Act 2007.<br />

Offences under <strong>the</strong> Liquor Act 2007, <strong>the</strong> <strong>Registered</strong> <strong>Clubs</strong> Act, <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es<br />

Act and <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>e Tax Act are dealt with by <strong>the</strong> Local Court.<br />

Until recently, key liquor and gam<strong>in</strong>g regulation responsibilities resided with <strong>the</strong><br />

Licens<strong>in</strong>g Court <strong>of</strong> <strong>NSW</strong> (Licens<strong>in</strong>g Court) and <strong>the</strong> <strong>NSW</strong> Liquor Adm<strong>in</strong>istration<br />

Board (LAB). Changes enacted via <strong>the</strong> new liquor licens<strong>in</strong>g regime have essentially<br />

seen <strong>the</strong> powers and responsibilities <strong>of</strong> <strong>the</strong> Licens<strong>in</strong>g Court and <strong>the</strong> LAB transferred<br />

to <strong>the</strong> CLGCA, <strong>the</strong> Director <strong>of</strong> Liquor and Gam<strong>in</strong>g, and <strong>the</strong> Local Court.<br />

O<strong>the</strong>r functions and powers conferred upon <strong>the</strong> CLGCA and <strong>the</strong> Director <strong>of</strong> Liquor<br />

and Gam<strong>in</strong>g <strong>in</strong>clude:<br />

declaration <strong>of</strong> devices as approved poker mach<strong>in</strong>es or approved amusement<br />

devices<br />

authorisation <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es <strong>in</strong> registered clubs and hotels<br />

determ<strong>in</strong>ation <strong>of</strong> Gam<strong>in</strong>g Social Impact Assessments for additional gam<strong>in</strong>g<br />

mach<strong>in</strong>es <strong>in</strong> registered clubs and hotels as well as <strong>the</strong> relocation <strong>of</strong> exist<strong>in</strong>g<br />

mach<strong>in</strong>es<br />
