1 Introduction<br />
1.2 O<strong>the</strong>r reviews and impend<strong>in</strong>g changes to <strong>the</strong> clubs <strong>in</strong>dustry’s<br />
regulatory environment<br />
IPART has been conscious <strong>of</strong> two o<strong>the</strong>r reviews by <strong>the</strong> Office <strong>of</strong> Liquor, Gam<strong>in</strong>g and<br />
Rac<strong>in</strong>g (OLGR) that have been happen<strong>in</strong>g concurrently, <strong>in</strong>clud<strong>in</strong>g:<br />
<strong>the</strong> five-year statutory review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act 2001<br />

The <strong>Review</strong> <strong>of</strong> <strong>the</strong> Community Development and Support Expenditure (CDSE)<br />
Scheme Guidel<strong>in</strong>es.<br />
In addition, it was aware that changes to <strong>the</strong> regulatory environment for clubs are<br />
imm<strong>in</strong>ent as a result <strong>of</strong> <strong>the</strong> passage <strong>of</strong> <strong>the</strong> Liquor Act 2007 and o<strong>the</strong>r associated<br />
legislation.<br />
IPART advised stakeholders over <strong>the</strong> course <strong>of</strong> its review that where matters are<br />
properly dealt with through <strong>the</strong>se o<strong>the</strong>r processes, it will try to avoid trespass<strong>in</strong>g on<br />
o<strong>the</strong>rs’ responsibilities. The follow<strong>in</strong>g sections outl<strong>in</strong>e IPART’s approach to areas<br />
that could overlap with <strong>the</strong>se reviews.<br />
1.2.1 Five-year statutory review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act 2001<br />
On 7 December 2007 <strong>the</strong> M<strong>in</strong>ister for Gam<strong>in</strong>g and Rac<strong>in</strong>g tabled a report on <strong>the</strong> fiveyear<br />
statutory review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act 2001 <strong>in</strong> <strong>the</strong> <strong>NSW</strong> Parliament which<br />
recommended various changes to <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act. Given that <strong>the</strong><br />
statutory review was concurrent with IPART’s review, IPART’s review has generally<br />
not exam<strong>in</strong>ed issues concern<strong>in</strong>g <strong>the</strong> operation and movement <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>e<br />
entitlements. However, <strong>the</strong>re are two areas where gam<strong>in</strong>g mach<strong>in</strong>e entitlement<br />
issues have been raised that are relevant to <strong>the</strong> terms <strong>of</strong> reference <strong>of</strong> IPART’s review:<br />

provisions relat<strong>in</strong>g to <strong>the</strong> transfer <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>e entitlements between<br />
premises (eg, when two clubs amalgamate)<br />
provisions relat<strong>in</strong>g to <strong>the</strong> number <strong>of</strong> entitlements available to new clubs.<br />
Stakeholders raised both <strong>of</strong> <strong>the</strong>se issues as barriers to club amalgamation and<br />
establishment.<br />
The report on <strong>the</strong> review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act recommends changes to both<br />
<strong>of</strong> <strong>the</strong>se provisions. These changes and <strong>the</strong>ir implications for club amalgamation and<br />
establishment are discussed <strong>in</strong> greater detail <strong>in</strong> Chapters 11 and 12.<br />
