3 Understand<strong>in</strong>g <strong>the</strong> social contributions <strong>of</strong> <strong>the</strong> registered<br />
clubs <strong>in</strong>dustry<br />
OLGR recently completed its five-year statutory review <strong>of</strong> <strong>the</strong> Gam<strong>in</strong>g Mach<strong>in</strong>es Act.<br />
This review has re<strong>in</strong>forced <strong>the</strong> Government’s commitment to <strong>the</strong> policy approach<br />
noted above. The review found that reduc<strong>in</strong>g <strong>the</strong> harm that can be associated with<br />
gambl<strong>in</strong>g on gam<strong>in</strong>g mach<strong>in</strong>es and <strong>the</strong> enforcement <strong>of</strong> <strong>the</strong> responsible conduct <strong>of</strong><br />
gambl<strong>in</strong>g across <strong>the</strong> <strong>in</strong>dustry rema<strong>in</strong> appropriate objectives for <strong>the</strong> Gam<strong>in</strong>g<br />
Mach<strong>in</strong>es Act. IPART notes <strong>the</strong> follow<strong>in</strong>g measures that address <strong>the</strong>se objectives:<br />

The Gam<strong>in</strong>g Mach<strong>in</strong>es Act places limits on <strong>the</strong> number <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es <strong>in</strong><br />
<strong>NSW</strong>. It caps <strong>the</strong> number <strong>of</strong> approved gam<strong>in</strong>g mach<strong>in</strong>es <strong>in</strong> hotels and clubs at<br />
104,000 (25,980 <strong>of</strong> which can be <strong>in</strong> hotels and 78,020 <strong>in</strong> registered clubs). It also<br />
sets venue-level caps on gam<strong>in</strong>g mach<strong>in</strong>e numbers (30 for hotels and 450 for most<br />
registered clubs). A club must also forfeit one gam<strong>in</strong>g mach<strong>in</strong>e entitlement for<br />
every two or three gam<strong>in</strong>g mach<strong>in</strong>e entitlements it sells or transfers between<br />
premises. The review recommends that given <strong>the</strong> reduction over time <strong>in</strong> <strong>the</strong><br />
overall number <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es <strong>in</strong> <strong>NSW</strong> 63 , <strong>the</strong> state-wide cap should be<br />
reduced to <strong>the</strong> current level <strong>of</strong> entitlements (99,000) and <strong>the</strong> legislation should be<br />
amended to allow for a mechanism for <strong>the</strong> automatic reduction <strong>of</strong> <strong>the</strong> cap over<br />
time.<br />
Hotels and registered clubs seek<strong>in</strong>g additional gam<strong>in</strong>g mach<strong>in</strong>es, or seek<strong>in</strong>g to<br />
<strong>in</strong>stall gam<strong>in</strong>g mach<strong>in</strong>es <strong>in</strong> a new hotel or new club, must submit a local impact<br />
assessment (LIA). These assessments are necessary to assess <strong>the</strong> impact <strong>of</strong><br />
additional gam<strong>in</strong>g mach<strong>in</strong>es on communities. Some venues seek<strong>in</strong>g to <strong>in</strong>crease<br />
<strong>the</strong>ir gam<strong>in</strong>g mach<strong>in</strong>e numbers significantly may also be required to enter <strong>in</strong>to a<br />
community contract to provide for amenities required by <strong>the</strong> local community,<br />
such as sport<strong>in</strong>g, educational or cultural facilities.<br />
Through <strong>the</strong> Responsible Gambl<strong>in</strong>g Fund, <strong>the</strong> Government is provid<strong>in</strong>g<br />
$31 million over <strong>the</strong> next four years for a state-wide network <strong>of</strong> 50-plus<br />
counsell<strong>in</strong>g and support services. 64<br />
Given <strong>the</strong> implementation <strong>of</strong> <strong>the</strong>se measures, IPART considers that government<br />
support <strong>in</strong>tended to facilitate a susta<strong>in</strong>able clubs <strong>in</strong>dustry, which may <strong>in</strong>clude<br />
encourag<strong>in</strong>g <strong>the</strong> establishment <strong>of</strong> new clubs, should not lead to an overall <strong>in</strong>crease <strong>in</strong><br />
<strong>the</strong> community’s access to gam<strong>in</strong>g mach<strong>in</strong>es. Although <strong>the</strong>re are costs associated<br />
with <strong>the</strong> operation <strong>of</strong> gam<strong>in</strong>g mach<strong>in</strong>es, <strong>the</strong> Government’s <strong>in</strong>tegrated policy<br />
framework seeks to ensure that <strong>the</strong>se costs do not exceed <strong>the</strong> benefits provided by<br />
<strong>the</strong> <strong>in</strong>dustry.<br />
Never<strong>the</strong>less, given IPART’s f<strong>in</strong>d<strong>in</strong>g on <strong>the</strong> reliance <strong>of</strong> clubs on gam<strong>in</strong>g mach<strong>in</strong>e<br />
revenue (see Chapter 6), IPART considers it important to consider <strong>the</strong> costs<br />
associated with this form <strong>of</strong> revenue.<br />
